ATTACHMENT 2 FIRST AMENDMENT TO DESIGN PROFESSIONAL SERVICES AGREEMENT This First Amendment for architectural services, is entered into this day of 2014 by the City of Pleasanton ("City") and Keller Mitchell & Co., whose address is a 302 Fourth Street, Oakland California (hereinafter referred to as "Architect"); RECITALS WHEREAS, the City entered into a Design Professional Services Agreement with the Architect dated December 17, 2013 for landscape architectural design services for the design of the Main Street Green Park for a fee of not to exceed $20,000 (hereinafter referred to as "Agreement"); and WHEREAS, since the approval of the Agreement, the Pleasanton City Council renamed the park "Rotary Park" and directed City staff to prepare a funding plan and construction schedule to have Phase I of the park fully constructed no later than May 9, 2014; and WHEREAS, City staff solicited additional design and construction administration services from the Architect related to preparing design specifications and construction administration, and WHEREAS, City has recommended that the City Council amend the Agreement with the Architect to include those services and fees as detailed in Attachment A to the amendment; NOW THEREFORE, the parties agree to amend the Agreement as follows: SECTION 1: Consultant Services is amended to include the services as specified in Attachment A to this Amendment. SECTION 4: Term is amended to change the estimated project completion date from June 30, 2015 to September 30, 2015. SECTION 5: Compensation is amended to include $27,500 in fees as compensation for the services detailed in Attachment A to the Agreement. The total compensation is amended from $20,000 to $47,500. All other terms and conditions of the Agreement shall remain in full force and effect In witness whereof, authorized representatives of the parties have executed this First Amendment to the Agreement as of the date and year first above written.
