RESOLUTION NO. 14-701 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> QUITCLAIMING CITY'S INTEREST AS TO SMALL PORTIONS OF OWENS DRIVE <br /> AND WILLOW ROAD NO LONGER NEEDED AS PUBLIC RIGHTS OF WAY OR <br /> PUBLIC SERVICE EASEMENTS <br /> WHEREAS, on April 17, 2012, the City Council approved Ordinance No. 2035 for a <br /> planned unit development (PUD-85-08-12D) for a residential and commercial development <br /> project, and related mitigated negative declaration by Resolution 12-522; and <br /> WHEREAS, Essex, the current owner of the property comprising PUD-85-08-12D, at the <br /> southeast corner of Owens Drive and Willow Road, has finalized detailed construction plans and <br /> requests that the City quitclaim small portions of the public right-of-way and public service <br /> easement that Essex proposes to incorporate into its project and remove from City responsibility <br /> for maintenance; and <br /> WHEREAS, Essex has also asked the Hacienda Business Park Owners Association to <br /> quitclaim its interests in the same property, and the Association has agreed to such request; <br /> and <br /> WHEREAS, the City has no future need or interest in such property. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. It finds that the quitclaim is consistent with the General Plan, PUD plan <br /> and mitigated negative declaration for PUD-85-08-12D. <br /> SECTION 2. The City Manager is authorized to sign a deed quitclaiming the City of <br /> Pleasanton's right, title and interest to nine (9) small areas of real property from Public Rights of <br /> Way and two areas of Public Service Easements, being portions of Owens Drive and Willow <br /> Road, as more fully described in the attached Exhibits A and B. <br /> SECTION 3. The City Clerk may record this resolution as part of the quitclaim deed, if <br /> required. <br /> SECTION 4. This resolution shall become effective immediately upon its adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on July 15, 2014. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 15"' day of July <br /> 2014 by the following vote: <br /> Ayes: Councilmembers Brown, Cook-Kallio, Narum, Pentin, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br />
