(BPC § 4605) <br /> 24)Provides that it is an unfair business practice for any person <br /> to hold himself or herself out or use the title of "certified <br /> massage therapist" or "certified massage practitioner" or any <br /> other term, such as "licensed," "registered," or "CMT," that <br /> implies or suggests that the person is certified as a massage <br /> therapist or practitioner without meeting the requirements for <br /> certification, and that any person who violates this provision <br /> shall be guilty of a misdemeanor. (BPC § 4606) <br /> 25)Provides that the superior court in and for the county in which <br /> any person acts as a massage practitioner or massage therapist <br /> in violation of any of the provisions of the Act may upon <br /> petition from any person issue an injunction or appropriate <br /> order restraining such conduct. (BPC § 4607) <br /> 26)Provides that the holder of a certificate issued by the CAMTC <br /> shall be able to practice massage in any city, county, or city <br /> and county, and shall not be subject to any ordinance enacted by <br /> any local government that regulates individuals practicing <br /> massage. (BPC § <br /> 4612 (a) (2)) <br /> 29)Provides that nothing in the Act shall prevent a city, county, <br /> or city and county from adopting or enforcing any local <br /> ordinance governing zoning, business licensing, and reasonable <br /> health and safety requirements for massage establishments or <br /> businesses that employs or uses persons who are not certified <br /> pursuant to the Act. <br /> (BPC § 4612 (a) (3) ) <br /> 30)Requires that any massage establishments or businesses that are <br /> sole proprietorships, where the sole proprietor is certified, or <br /> that employ or use only persons certified pursuant to the Act, <br /> to maintain on its premises evidence for review by local <br /> authorities that demonstrates that all persons providing massage <br /> services are certified; and nothing shall prevent local <br /> authorities from including in an ordinance a requirement for <br /> these massage businesses to file copies or provide other <br /> evidence of the certificates held by persons who are providing <br /> massage services.
