AB 1147 —6— <br /> I (commencing with Section 51 10) of Division 2 of Title 1 of the <br /> 2 Corporations Code,and that is not managed by any entity for profit. <br /> 3 (C) A for-profit institution. <br /> 4 (D) An institution that does not meet all of the criteria in <br /> 5 subparagraph (B) that is incorporated and lawfully operating as a <br /> 6 nonprofit public benefit corporation pursuant to Part 2 <br /> 7 (commencing with Section 5110) of Division 2 of Title 1 of the <br /> 8 Corporations Code, that has been in continuous operation since <br /> 9 April 15, 1997, and that is not managed by any entity for profit. <br /> 10 (4) Is a college or university of the state higher education system, <br /> 11 as defined in Section 100850 of the Education Code. <br /> 12 (5) Is a school requiring equal or greater training than what is <br /> 13 required pursuant to this chapter and is recognized by the <br /> 14 corresponding agency in another state or accredited by an agency <br /> 15 recognized by the United States Department of Education. <br /> 16 (b) "Certificate" means a valid certificate issued by the council <br /> 17 pursuant to this chapter. <br /> 18 (c) "Compensation"means a payment,loan,advance,donation, <br /> 19 contribution, deposit, or gift of money, or anything of value. <br /> 20 (d) "Council" means the California Massage Therapy Council <br /> 21 created pursuant to this chapter, which shall be a nonprofit <br /> 22 organization exempt from taxation under Section 501(c)(3)of Title <br /> 23 26 of the United States Code. <br /> 24 (e) "Massage" means the scientific manipulation of the soft <br /> 25 tissues. For purposes of this chapter, the terms "massage" and <br /> 26 "bodywork" shall have the same meaning. <br /> 27 (0 "Massage establishment"or"establishment"means a location <br /> 28 where massage is performed for compensation, excluding those <br /> 29 locations where massage is only provided on an out-call basis. <br /> 30 (g) "Massage practitioner" means a person who is certified by <br /> 31 the council pursuant to Section 4604.2 and who administers <br /> 32 massage for compensation. <br /> 33 (h) "Massage therapist"means a person who is certified by the <br /> 34 council under Section 4604 and who administers massage for <br /> 35 compensation. <br /> 36 (i) "Operator" means a person, whether owner or nonowner, <br /> 37 who meets the requirements of Section 4604.1.An operator need <br /> 38 not be an owner of the establishment or a certified massage <br /> 39 therapist or practitioner. <br /> 90 <br />
