THE CITY OF <br /> CITY COUNCIL AGENDA REPORT 1 <br /> pL EASANTON. <br /> July 15, 2014 <br /> Community Development <br /> Planning Division <br /> TITLE: P14-0704 - CONSIDER INTRODUCTION OF AN ORDINANCE <br /> APPROVING A DEVELOPMENT AGREEMENT TO VEST THE <br /> DEVELOPMENT APPROVALS OF THE AUSTIN PROJECT (PUD-58 <br /> AND TENTATIVE TRACT 7813) CONSISTING OF EIGHT (8) SINGLE- <br /> FAMILY RESIDENTIAL LOTS AND 22 ACRES OF PERMANENT <br /> OPEN SPACE AT 3459 OLD FOOTHILL ROAD FOR A TEN-YEAR <br /> PERIOD FROM 2014 TO 2024 WITH A FIVE-YEAR OPTION <br /> APPLICANT: BRAD HIRST <br /> SUMMARY <br /> The application, submitted on behalf of the Austin's, requests that PUD-58 and <br /> Tentative Tract Map - 7813 be vested for a ten-year period from 2014 to 2024 with a <br /> five-year option through the approval of a Development Agreement. <br /> PLANNING COMMISSION RECOMMENDATION <br /> On June 11, 2014, the Planning Commission recommended approval of the <br /> Development Agreement subject to the draft Agreement (Attachment 1) to the City <br /> Council. <br /> RECOMMENDATION <br /> 1. Introduce the draft ordinance approving Case P14-0704, the Development <br /> Agreement for the project (Attachment 1). <br /> FINANCIAL STATEMENT <br /> There is no financial impact to the City. As originally approved, the project developer will <br /> be required to construct the required improvements to Foothill Road and Old Foothill <br /> Road to accommodate the proposed project. The project developer will be required to <br /> pay all City development fees including school impact fees at the time of development. <br /> The homes covered by this application would pay property taxes that would go to offset <br /> their impact to City services including police, fire, support staff, etc. at the time of <br /> construction. <br />
