BACKGROUND <br /> On March 4, 2014, as part of the 2014 LPFD Weed Abatement Program, the City <br /> Council adopted Resolution No. 14-661 , which declared that weeds on specified <br /> properties constituted a public nuisance, ordered the abatement thereof, and set a <br /> public hearing to hear objections to the proposed abatement. On April 15, 2014, the <br /> City Council adopted Resolution No. 14-672, which ordered the abatement of weeds on <br /> the parcels identified in Resolution No. 14-661 and declared that the weed abatement <br /> costs, including a 100% mark up charge for administrative costs, are the responsibility <br /> of the property owner. <br /> This agenda report is the third and final agenda report to the City Council regarding the <br /> 2014 Weed Abatement Program. After the City Council meeting on April 15, 2014, fire <br /> inspectors re-surveyed the parcels for compliance. A contractor hired by the City abated <br /> the weeds and reduced the hazard on parcels which were non compliant after the May <br /> 31, 2014 deadline. <br /> The Government Code provides that the abatement costs, including the administrative <br /> costs for enforcement, are recoverable and constitute a special assessment against the <br /> parcels that are abated. After the assessment is made, unless an exception applies, a <br /> lien attaches on the parcel upon recordation of the order confirming the assessment and <br /> the lien will be included on the property owner's regular tax bill for the parcel requiring <br /> abatement. Property owners have until July 15th at 5:00 pm to pay the invoice to avoid it <br /> being placed on their tax bill. An itemized report showing the cost of weed abatement <br /> on a lot-by-lot basis throughout the City is attached to the resolution that accompanies <br /> this agenda report. <br /> DISCUSSION <br /> At this hearing, after considering any and all objections to the proposed abatement, the <br /> City Council should overrule the objections to the proposed abatement and/or move to <br /> amend the list of properties abated. <br /> Submi b : odtk Fiscal Review: G O Approve by: <br /> James Miguel Emily .
