THE CITY OF <br /> CITY COUNCIL AGENDA REPORT 4 <br /> pL EASANTON. <br /> July 15, 2014 <br /> Community Development Department <br /> Planning Division <br /> TITLE: APPROVE PROFESSIONAL SERVICES AGREEMENT WITH <br /> ENVIRONMENTAL SCIENCE ASSOCIATES (ESA) FOR SERVICES <br /> INVOLVING THE PREPARATION OF AN ENVIRONMENTAL IMPACT <br /> REPORT (EIR) FOR THE JOHNSON DRIVE ECONOMIC DEVELOPMENT <br /> ZONE IN THE AMOUNT NOT TO EXCEED $142,326, AND RELATED <br /> REIMBURSEMENT AGREEMENT WITH NEARON ENTERPRISES, LLC <br /> SUMMARY <br /> Staff is requesting approval of a professional services agreement with ESA to provide <br /> environmental review services for preparation of an EIR pursuant to the California <br /> Environmental Quality Act (CEQA) evaluating the effects of the Johnson Drive Economic <br /> Development Zone. The Johnson Drive Economic Development Zone would involve a <br /> General Plan Amendment and Planned Unit Development (PUD) Rezoning <br /> encompassing up to eleven parcels along Johnson Drive (Attachment 3) in order to <br /> enhance their long-term value to the community and property owners. The agreement will <br /> be in an amount not to exceed $142,326, which includes a 10 percent contingency. <br /> Nearon Enterprises will reimburse the City for the full costs via a reimbursement <br /> agreement (Attachment 2). <br /> RECOMMENDATION <br /> 1. Authorize the City Manager to execute a Professional Services Agreements with ESA <br /> for services related to preparation of an EIR, not to exceed $142,326, in generally the <br /> form shown in Attachment 1, subject to minor modifications approved by the City <br /> Manager and City Attorney. <br /> 2. Authorize the City Manager to execute a reimbursement agreement with Nearon <br /> Enterprises for reimbursement of all costs associated with the professional services <br /> agreement with ESA, in generally the form shown in Attachment 2, subject to minor <br /> modifications approved by the City Manager and City Attorney. <br /> FINANCIAL STATEMENT <br /> The cost of the professional services agreement would be paid by Nearon Enterprises. <br /> Planning Division review and administration will be conducted by staff and is part of the <br /> Current Planning budget. <br />
