ORDINANCE NO. 2099 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE APPLICATION OF HENDRICK AUTOMOTIVE GROUP FOR MAJOR MODIFICATION TO A PLANNED UNIT DEVELOPMENT (PUD) PLAN APPROVAL, AS FILED UNDER CASE PUD-85-02-02D-06M WHEREAS, Hendrick Automotive Group has applied for a Major Modification to a Planned Unit Development plan to demolish the four buildings on the subject site and the construct an approximately 83,300 square-foot showroom, service facility, car wash, and related site improvements at 4335-4345 Rosewood Drive for Lexus of Pleasanton (the "Project"); and WHEREAS, zoning for the property is Planned Unit Development — Central Commercial (PUD-C-C) District; and WHEREAS, at its meeting of April 23, 2014, the Planning Commission adopted Resolution PC-2014-20, determining that the proposed development plan is appropriate for the site, making findings, and recommending to the Pleasanton City Council that the Project, PUD-85-02-02D-06M, be approved; and WHEREAS, on May 20, 2014, the Pleasanton City Council held a duly noticed public hearing on this application and considered all public testimony, agenda reports, and related materials, and the recommendations of City staff and the Planning Commission; and WHEREAS, the City Council determined that this project is categorically exempt from environmental review pursuant to California Environmental Quality Act Guidelines, Section 15332, In-Fill Development Projects, Class 32; and WHEREAS, the City Council finds that the proposed Major Modification to the PUD development plan is consistent with the City's General Plan and purposes of the PUD ordinance, and by this reference adopts and reaffirms all of the considerations and findings set forth in Planning Commission Resolution PC-2014-20. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. It approves Case PUD-85-02-02D-06M, the application of Hendrick Automotive Group for Major Modification to a Planned Unit Development plan to demolish the four buildings on the subject site and the construct an approximately 83,300 square-foot showroom, service facility, car wash, and related site improvements at 4335-4345 Rosewood Drive, subject to the conditions as shown in Exhibit A, attached hereto and made part of this ordinance by this reference.
