CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 921 <br /> <br /> AN ORDINANCE APPROVING A DEVELOPMENT PLAN FOR A <br /> RESTAURANT TO BE LOCATED ON A 0.9 ACRE PORTION OF <br /> A 6.1 ACRE SITE LOCATED AT THE SOUTHEAST CORNER OF <br /> HOPYARD ROAD AND 1-580 <br /> <br />WHEREAS, the City Council, on September 18, 1979, adopted Ordinance No. <br /> 903 which rezoned an approximately 6.1 acre parcel Of land <br /> located at the southeast corner of Hopyard Road and 1-580 to <br /> the PUD (Planned Unit Development) District; and <br /> <br />WHEREAS, the applicant, pursuant to rezoning established by Ordinance <br /> No. 903, has prepared a development plan; and <br /> <br />WHEREAS, the Planning Commission at its November 14, 1979, meeting <br /> considered and approved, by the adoption of Resolution No. <br /> 1825, case PUD79-12, the application of Henry Cuppies, for <br /> approval of a development plan for a restaurant to be located <br /> on a 0.9 acre portion of this approximate 6.1 acre site (sub- <br /> ject to all conditions set forth in Staff Report dated November <br /> 14, 1979, attached to Resolution No. 1825 and made a part there- <br /> of); and <br /> <br />WHEREAS, at its meeting of November 27, 1979, the City Council reviewed <br /> the development plan for PUD-79-12 and adopted Resolution #79-238 <br /> approving a negative declaration for this application; <br />NOW, THEREFORE, THE CITY COUNCIL OF 'THE CITY OF PLEASANTON DOES ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1. The development plan as shown in PUD79-12 for a restaurant <br /> to be located on a 0.9 acre portion of a 6.1 acre site located <br /> at the southeast corner of Hopyard Road and 1-580 is hereby <br /> approved subject to the conditions attached hereto as Exhibit <br /> A and made a part hereof by reference. <br /> <br />Section 2. This ordinance shall become effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> <br />Section 3. This ordinance shall be published once within fifteen (15) <br /> days after the date of its adoption in "THE TIMES" a newspaper <br /> of general circulation, published in the City of Pleasanton. <br /> <br />INTRODUCED at a regular meeting of the City Council of the City of <br /> Pleasanton on November 27, 1979. <br /> <br />ADOPTED at a regular meeting of the City Council of the City of <br /> Pleasanton on December 11, 1979, by the following vote: <br /> <br />AYES: Councilmembers Butler, Kephart, I~ercer, Wood and Mayor Brandes <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />III <br /> <br /> <br />
