ORDINANCE NO. 2098 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF CARMAX AUTO SUPERSTORES FOR <br /> PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT PLAN APPROVAL, AS <br /> FILED UNDER CASE PUD-98 <br /> • <br /> WHEREAS, CarMax Auto Superstores has applied for Planned Unit Development plan <br /> approval to construct an automobile dealership consisting of an approximately 11,783 square <br /> foot sales end presentation building, an approximately 45,000 square foot service building, an <br /> approximately 3,930 square foot quality control building and non-public car wash,:vehicle sales <br /> display area, and related site improvements on approximately 19.66 acres of the Auto Mall site <br /> at Staples Ranch (the "Project");and <br /> WHEREAS, zoning for the property is Planned Unit Development—Commercial (PUD- <br /> C) District; and <br /> WHEREAS, after a February 2014 workshop, at its meeting of April 9, 2014, the <br /> Planning Commission adopted Resolution PC-2014-14, determining that the proposed <br /> development plan is appropriate for the site, making findings, and recommending to the <br /> Pleasanton City Council that PUD-98 be approved; and <br /> WHEREAS, on May 6, 2014, the Pleasanton City Council held a duly noticed public <br /> hearing on this application and considered all public testimony, agenda reports, and related <br /> materials, and the recommendations of City staff and the Planning Commission; and <br /> WHEREAS, the City Council determined that the conditions described in California <br /> Environmental Quality Act (CEQA) Guidelines Section 15162 have not occurred as described in <br /> the Addendum to the EIR and SEIR and find that the previously prepared EIR and SEIR, <br /> including the adopted CEQA Findings and Statement of Overriding Considerations, and the <br /> Addendum to the EIR and SEIR are adequate to serve as the environmental documentation for <br /> this project and satisfy all the requirements of CEQA; and <br /> WHEREAS, the Pleasanton City Council finds that the proposed PUD development <br /> plan is consistent with the City's General Plan, the Stoneridge Drive Specific Plan <br /> Amendment/Staples Ranch and purposes of the PUD ordinance, and by this reference adopts <br /> and reaffirms all of the considerations and findings set forth in Planning Commission Resolution <br /> PC-2014-14. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. It approves Case PUD-98, the application of CarMax Auto Superstores <br /> for Planned Unit Development plan to construct an automobile dealership consisting of an <br /> approximately 11,783 square foot sales and presentation building, an approximately 45,000 <br /> square foot service building, an approximately 3,930 square foot quality control building and <br /> non-public car wash, vehicle sales display area, and related site improvements on <br /> approximately 19.66 acres of the Auto Mall site at Staples Ranch, subject to the conditions as <br /> shown in Exhibit A-1, attached hereto and made part of this ordinance by this reference. <br /> • <br />
