10 <br /> ORDINANCE NO. 2102 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF MIDPEN HOUSING CORPORATION FOR <br /> PLANNED UNIT DEVELOPMENT (PUD) REZONING APPROVAL, AS FILED UNDER <br /> CASE PUD-101 <br /> WHEREAS, MidPen Housing Corporation has applied for PUD Rezoning approval to <br /> modify the zoning on a 6.43 acre site located at 240 and 251 Kottinger Drive, 4138 Vineyard <br /> Avenue, and 4133 Regalia Court from RM-2,500 and RM-4,000 (Multi-Family Residential) <br /> Districts and R-t-6,500 (One-Family Residential) District to Planned Unit Development — High <br /> Density Residential (PUD-HDR) ("the Project"); and <br /> WHEREAS, the Planning Commission at its regular meeting on April 23, 2014 adopted <br /> Resolution PC-2014-18, determining that the proposed rezoning is appropriate for the site, <br /> making findings, and recommending to the Pleasanton City Council that PUD-101 be approved; <br /> and <br /> WHEREAS, on May 20, 2014, the Pleasanton City Council held a duly noticed public <br /> hearing on this application and considered all public testimony, agenda reports, and related <br /> materials, and the recommendations of City staff and the Planning Commission; and <br /> WHEREAS, the City Council finds that the proposed PUD rezoning is consistent with the. <br /> City's General Plan, which is simultaneously being amended in conjunction with the Project, and <br /> the purposes of the PUD Ordinance. <br /> NOW, THEREFORE,THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. A Mitigated Negative Declaration has been prepared for the proposed <br /> Project. Based on an initial study, the project-related impacts are mitigated, with the mitigation <br /> measures incorporated in the Project's design or required by conditions of approval, and that <br /> there would be no significant or unmitigated environmental impacts. Therefore, a Mitigated <br /> Negative Declaration is issued in conformance with the California Environmental Quality Act <br /> (CEQA). <br /> SECTION 2. Case PUD-101, the application of MidPen Housing Corporation to modify <br /> the zoning on the properties located at 240 and 251 Kottinger Drive, 4138 Vineyard Avenue, <br /> and 4133 Regalia Court from RM-2,500 and RM-4,000 (Multi-Family Residential) Districts and <br /> R-1-6,500 (One-Family Residential) District to Planned Unit Development High Density <br /> Residential (PUD-HDR), a copy of Zoning Unit Map No. 489 is attached as Exhibit A and is on <br /> file in the Community Development Department, and made part of this ordinance by this <br /> reference, is approved. <br /> SECTION 3. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in 'The Valley Times", a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br /> City Clerk' s Office within fifteen (15) days after its adoption. <br />
