RESOLUTION NO. 14486 :.. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A.MITIGATED NEGATIVE DECLARATION FOR THE APPLICATION OF <br /> MIDPEN HOUSING CORPORATION, AS FILED UNDER CASE P.14-0011 AND PUD- <br /> 101 <br /> WHEREAS, at its meeting of May 20, 2014, the City Council received a proposed <br /> Mitigated Negative Declaration for the application of MidPen Housing Corporation, for a General <br /> Plan Amendment and Planned Unit Development (PUD) Rezoning and Development Plan to <br /> construct 185 senior apartment units and related site improvements on an approximately 6.43 <br /> acre site located at 240 and 251 Kottinger Drive, 4138 Vineyard Avenue, and 4133 Regalia <br /> Court ('the Project"); and <br /> WHEREAS, the Planning Commission at its regular meeting on April 23, 2014 adopted <br /> Resolution PC-2014-16, determining that the proposed Mitigated Negative Declaration is <br /> appropriate for the Project, making findings, and recommending to the Pleasanton City Council <br /> that the proposed Mitigated Negative Declaration for P14-0011 and PUD-101 be approved; and <br /> WHEREAS, the City Council received and reviewed the Initial Study, dated March 2014, <br /> and received the recommendations of the staff and Planning Commission; and <br /> WHEREAS, on May 20, 2014, the Pleasanton City Council held a duly noticed public <br /> hearing, at which time the public was given the opportunity to comment on the environmental <br /> impact of the Project;and <br /> WHEREAS, the City Council has reviewed the potential impacts in accordance with the <br /> applicable state and 'local guidelines governing the preparation of the Mitigated Negative <br /> Declaration; and <br /> WHEREAS the City. Council find the Project, as mitigated, would not have any <br /> significant adverse effects on the environment. <br /> NOW, THEREFORE; BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE <br /> FOLLOWING: <br /> SECTION 1.. The Mitigated Negative Declaration and Mitigation Monitoring and <br /> Reporting Plan for the application of MidPen Housing Corporation, for a General Plan <br /> Amendment and PUD Rezoning and Development Plan to construct 185 senior apartment units <br /> and related site improvements on an approximately 6.43 acre site located at 240 and 251 <br /> Kottinger Drive, 4138 Vineyard Avenue, and 4133 Regalia Court, is hereby approved. <br /> SECTION 2. The City staff is directed to cause a Notice of Determination to be filed <br /> pursuant to Section 5.4(g) of Resolution No. 77-66. <br /> PASSED, APPROVED,AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on May 20,2014. <br />
