ORDINANCE NO. 2096 7 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF FRANK AND BARBARA BERLOGAR FOR <br /> PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-84 <br /> WHEREAS, Frank and Barbara Berlogar have applied for Planned Unit Development <br /> (PUD) plan approval to subdivide an approximately 37.4 acre site into three single-family <br /> residential lots: two lots measuring approximately 1.2 acres and 1.9 acres for custom homes; <br /> and one lot measuring approximately 34.3 acres for the existing dwelling and accessory <br /> located at the property located at 88 Silver Oaks Lane in the Vineyard Avenue <br /> Corridor Specific Plan Area; and <br /> WHEREAS, zoning for the property is PUD/HR/OS/Planned Unit Development-Low <br /> Density Residential/Hillside Residential/Open Space) District; and <br /> WHEREAS, the City Council determined that there were no changes to the <br /> environmental circumstances and impacts from the time that it certified the Environmental <br /> Impact Report for the Vineyard Avenue Corridor Specific Plan Area in March 1999 that require <br /> additional environmental review for this project; and <br /> WHEREAS, the City Council received the Planning Commission's positive <br /> recommendations for approval of the development plan; and <br /> WHEREAS, duly noticed hearing was held on April 15, 2014; and <br /> WHEREAS, the City Council finds that the development plan and site development <br /> standards are consistent with the General Plan policies, the Vineyard Avenue Corridor Specific <br /> Plan, and the purposes of the PUD ordinance of the City of Pleasanton. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, ANDORDER THE FOLLOWING: <br /> SECTION 1. It finds that the project is exempt from further environmental analysis <br /> pursuant to Government Code section 65457 because it is consistent with the Vineyard Avenue <br /> Corridor Specific Plan (VACSP) and the Pleasanton General Plan, and creates no new impacts <br /> which were not studied in the previously certified VACSP EIR. <br /> SECTION.2. It approves Case PUD-84, the application of Frank and Barbara Berlogar <br /> for Planned Unit Development (PUD) plan approval to subdivide an approximately 37.4-acre site <br /> into three single-family residential lots as shown in Alternative 2 site layout (with building pad <br /> elevation at 500 feet for Lot 2) on file in the Community Development Department two lots <br /> measuring approximately 1.2 acres and 1.9 acres for custom homes; and one lot measuring <br /> approximately 34.3 acres for the existing dwelling and accessory structures located at 88 Silver <br /> Oaks Lane in the Vineyard Avenue Corridor Specific Plan Area, subject to the conditions shown <br /> on Exhibit A, attached and incorporated by this reference. <br /> SECTION 3. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br /> City Clerk's office within fifteen (15) days after its adoption. <br />
