roosts being used for maternity or hibernation purposes. Bat roosts initiated <br /> during construction are presumed to be unaffected, and no buffer is necessary. <br /> 41. No new grading or development shall be allowed within 20 feet of the edge of <br /> riparian vegetation or top of bank of Arroyo Mocho, whichever is further from the <br /> creek centerline, as delineated by a qualified, City-approved biologist that shall be <br /> hired by the applicant/developer. Prior to issuance of a building or grading permit, <br /> the biologist shall certify in writing to the Director of Community Development that <br /> the project is in compliance with this condition. <br /> 42. In the event that paleontological resources are encountered during the course of <br /> development, all construction activity must temporarily cease in the affected <br /> area(s) until the uncovered fossils are properly assessed by a qualified <br /> paleontologist and subsequent recommendations for appropriate documentation <br /> and conservation are evaluated and approved by the City of Pleasanton. <br /> Excavation or disturbance may continue in other areas of the site that are not <br /> reasonably suspected to overlie adjacent or additional paleontological resources. <br /> These requirements shall be printed on the site, grading, and landscape plans <br /> where applicable to the satisfaction of the Director of Community Development. <br /> 43. In the event that human remains are discovered during grading or construction, <br /> work shall stop immediately. There shall be no disposition of such human <br /> remains, other than in accordance with the procedures and requirements set forth <br /> in California Health and Safety Code Section 7050.5 and Public Resources <br /> Section 5097.98. These code provisions require notification of the County <br /> Coroner and the Native American Heritage Commission, who in turn must notify <br /> the persons believed to be most likely descended from the deceased Native <br /> American for appropriate disposition of the remains. These requirements shall be <br /> printed on the site, grading, and landscape plans where applicable to the <br /> satisfaction of the Director of Community Development. <br /> 44. The applicant/developer shall implement construction best management practices <br /> to reduce construction noise, including: <br /> a) Locate stationary construction equipment as far from adjacent occupied <br /> buildings as possible. <br /> b) Select routes for movement of construction-related vehicles and equipment so <br /> that noise-sensitive areas, including residences and outdoor recreation areas, <br /> are avoided as much as possible. Include these routes in materials submitted <br /> to the City of Pleasanton for approval prior to the issuance of building permits. <br /> c) All site improvements and construction activities shall be limited to the hours of <br /> 8:00 a.m. to 5:00 p.m., Monday through Friday, and 9:00 a.m. — 5:00 p.m. on <br /> Saturday.
