ORDINANCE NO. 2090 <br /> AN ORDINANCE OF THE CITY OF PLEASANTON APPROVING THE <br /> APPLICATION OF SHAC LAW POSITAS APARTMENTS, L.L.C. FOR <br /> PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT PLAN APPROVAL, <br /> AS FILED UNDER CASE PUD-81-30-88D (FORMERLY PUD-103) <br /> WHEREAS, SHAC Las Positas Apartments, L.L.C. has applied for PUD <br /> development plan approval to construct 177 apartment units and related site <br /> improvements at the property located at 5850 West Las Positas Boulevard ("the <br /> Project"); and <br /> WHEREAS, zoning for the property is Planned Unit Development — Mix Use <br /> (PUD-MU) District; and <br /> WHEREAS, the Planning Commission at its regular meeting on February 26, <br /> 2014 adopted Resolution PC-2014-09, determining that the proposed development plan <br /> is appropriate for the site, making findings, and recommending to the Pleasanton City <br /> Council that PUD-81-30-88D (formerly PUD-103) be approved; and <br /> WHEREAS, on March 18, 2014, the Pleasanton City Council held a duly noticed <br /> public hearing on this application and considered all public testimony, agenda reports, <br /> and related materials, and the recommendations of City staff and the Planning <br /> Commission; and <br /> WHEREAS, the City Council finds that the exceptions to the Housing Site <br /> Development Standards and Design Guidelines as stated on pages 14 and 15 of the <br /> February 26, 2014, Planning Commission staff report are appropriate; and <br /> WHEREAS, the Pleasanton City Council finds that the proposed PUD <br /> development plan is consistent with the City's General Plan and purposes of the PUD <br /> ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. It determines that the conditions described in California <br /> Environmental Quality Act (CEQA) Guidelines Section 15162 have not occurred and <br /> finds that the previously prepared Supplemental Environmental Impact Report (SEIR), <br /> including the adopted CEQA Findings and Statement of Overriding Considerations in <br /> City Council Resolution 12-492, and the Addendum to the SEIR for the Project are <br /> adequate to serve as the environmental documentation for the Project and satisfy all the <br /> requirements of CEQA. <br />
