ATTACHMENT 1 <br /> ORDINANCE NO.xxx <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF FRANK AND BARBARA BERLOGAR <br /> FOR PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE <br /> PUD-84 <br /> WHEREAS, Frank and Barbara Berlogar have applied for Planned Unit <br /> Development (PUD) plan approval to subdivide an approximately 37.4 acre site into <br /> three single-family residential lots: two lots measuring approximately 1.2 acres and 1.9 <br /> acres for custom homes; and one lot measuring approximately 34.3 acres for the <br /> existing dwelling and accessory structures, located at the property located at 88 Silver <br /> Oaks Lane in the Vineyard Avenue Corridor Specific Plan Area; and <br /> WHEREAS, zoning for the property is PUD/HR/OS/Planned Unit Development- <br /> Low Density Residential/Hillside Residential/Open Space) District; and <br /> WHEREAS, the City Council determined that there were no changes to the <br /> environmental circumstances and impacts from the time that it certified the <br /> Environmental Impact Report for the Vineyard Avenue Corridor Specific Plan Area in <br /> March 1999 that require additional environmental review for this project; and <br /> WHEREAS, the City Council received the Planning Commission's positive <br /> recommendations for approval of the development plan; and <br /> WHEREAS, duly noticed hearing was held on April 15, 2014; and <br /> WHEREAS, the City Council finds that the development plan and site <br /> development standards are consistent with the General Plan policies, the Vineyard <br /> Avenue Corridor Specific Plan, and the purposes of the PUD ordinance of the City of <br /> Pleasanton. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND <br /> ORDER THE FOLLOWING: <br /> SECTION 1. It finds that the project is exempt from further environmental <br /> analysis pursuant to Government Code section 65457 because it is consistent with the <br /> Vineyard Avenue Corridor Specific Plan (VACSP) and the Pleasanton General Plan, <br /> and creates no new impacts which were not studied in the previously certified VACSP <br /> EIR. <br /> SECTION 2. It approves Case PUD-84, the application of Frank and Barbara <br /> Berlogar for Planned Unit Development (PUD) plan approval to subdivide an <br /> approximately 37.4-acre site into three single-family residential lots as shown in <br /> Alternative 1 site layout on file in the Community Development Department dated <br />
