RESOLUTION NO. 14-664 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF PLEASANTON AND SHAC LAS POSITAS APARTMENTS, L.L.C. AS FILED UNDER CASE NO. PUD-81-30-88D WHEREAS, SHAG Las Positas Apartments, L.L.C. has made an application to the City for an Affordable Housing Agreement for the construction of a multi-family residential development located at 5850 West Las Positas Boulevard, filed under Case No. PUD-81-30-88D; and WHEREAS, the Pleasanton Housing Commission reviewed the. Affordable Housing Agreement at its regular meeting on February 20, 2014; and WHEREAS, a duly-noticed public hearing was held by the City Council on March 18, 2014, at which time the public was given the opportunity to comment on the Affordable Housing Agreement; and WHEREAS, the City Council considered all the information presented at the public hearing regarding the terms of the Affordable Housing Agreement. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. It finds that the proposed Affordable Housing Agreement between the City of Pleasanton and SHAC Las Positas Apartments, L.L.C. is consistent with the City's General Plan and the objectives of the City's affordable housing polices. SECTION 2. It approves the Affordable Housing Agreement between the City of Pleasanton and SHAC Las Positas Apartments, L.L.C., a copy of which is attached hereto as Exhibit A and incorporated herein by this reference; and authorizes the City Manager to execute the Affordable Housing Agreement in generally the form attached as Exhibit A. SECTION 3. This resolution shall become effective immediately upon the effective date of the ordinances approving the PUD development plan and development agreement for this project.
