MOTION: It was m/s by Cook-Kallio/Pentin to delete General Plan references to a historic preservation <br /> ordinance. Motion carried by the following vote: <br /> Ayes: Councilmembers Brown, Cook-Kallio, Narum, Pentin, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Codify the ability to require story poles <br /> Councilmember Cook-Kallio requested an example of when staff might require story poles. <br /> Mr. Dolan described a two-story addition which approached the rear property line and was of concern <br /> to the neighbors. He noted that if neighbors voiced no objection, staff would not likely put the applicant <br /> through the effort or expense of erecting story poles. <br /> MOTION: It was m/s by Cook-Kallio/Narum to codify the ability to require story poles. Motion carried by <br /> the following vote: <br /> Ayes: Councilmembers Brown, Cook-Kallio, Narum, Pentin, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Expand demolition by neglect ordinance to apply to single-family homes in the Downtown Specific Plan <br /> Area <br /> Mayor Thorne requested an explanation of demolition by neglect. <br /> Mr. Dolan explained that it essentially means allowing a structure to deteriorate to such a point that it <br /> must be demolished. This provides the city with the ability to prevent neglect that would lead to such a <br /> situation. <br /> Vice-Mayor Pentin asked and Mr. Dolan confirmed that this applies to both the interior and exterior of a <br /> structure. <br /> Councilmember Brown requested an explanation of the enforcement procedure. <br /> Mr. Dolan explained that code enforcement would first contact the property owner to explain the <br /> violation and hopefully obtain compliance. Failure to comply would lead to further steps similar to those <br /> used on a commercial structure. <br /> Ms. Seto added that it is a progressive fine process and typically at a certain point, the property owner <br /> realizes it will be less expensive to resolve the problem than to continue receiving fines for <br /> noncompliance. <br /> Councilmember Cook-Kallio inquired about the consequences for a property owner allowing demolition <br /> by neglect to occur but claiming ignorance. <br /> Ms. Seto acknowledged that the resource would be lost but advised that it could drive how the city <br /> chooses to handle subsequent applications for the property. <br /> Mayor Thorne asked and staff confirmed that it also applies to bank-owned foreclosure properties. <br /> City Council Minutes Page 11 of 14 January 21,2014 <br />
