ATTACHMENT 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DENYING THE APPEAL BY ANIL AND DIVYA REDDY AND DETERMINING <br /> THAT 3 OF THE 7 ITEMS IN DISPUTE BETWEEN THE REDDYS AND THE <br /> RUBY HILL ARCHITECTURAL DESIGN COMMITTEE ARE IN SUBSTANIAL <br /> CONFORMANCE WITH THE RUBY HILL ARCHITECTURAL DESIGN <br /> GUIDELINES WHILE 4 ITEMS ARE NOT IN CONFORMANCE AND MUST BE <br /> MODIFIED BY THE REDDYS. <br /> WHEREAS, Anil and Divya Reddy have applied for Design Review Approval to <br /> evaluate the conformance of their existing single-family residence located at 3737 West <br /> Ruby Hill Drive (the "Project" or "P13-2028") to the Ruby Hill Architectural Design <br /> Guidelines (RHADG); and <br /> WHEREAS, zoning for the property is PUD — A/OS/LDR (Planned Unit <br /> Development—Agriculture, Open Space, and Low Density Residential (PUD-MDR); and <br /> WHEREAS, custom lot building designs in the Ruby Hill Development are <br /> subject to the RHADG administered by the Ruby Hill Architectural Design Committee <br /> (RHADC); and <br /> WHEREAS, the Planning Commission unanimously voted for Option 2 of the <br /> staff report, finding that the project does not conform to the RHADG and requiring that <br /> all seven of the disputed items be corrected in compliance with the RHADG as <br /> administered by the RHADC; and <br /> WHEREAS, on February 18, 2014, the Pleasanton City Council held a duly <br /> noticed public hearing on this application and considered all public testimony, agenda <br /> reports, and related materials, and the recommendations of City staff and the Planning <br /> Commission; and <br /> WHEREAS, the City Council finds that Option 1 as stated on pages 29 and 30 of <br /> the December 11, 2013, Planning Commission staff report is appropriate; and <br /> WHEREAS, the City Council determined that the project is categorically exempt <br /> from the California Environmental Quality ACT (CEQA) under Class 3 Categorical <br /> Exemption, Section 15303(a), New Construction or Conversion of Small Structures, of <br /> the CEQA Guidelines. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. It finds that the project at 3737 West Ruby Hill Drive as constructed <br /> is not consistent with the RHADG with regard to 4 of the 7 items in dispute by the <br /> Reddys and the RHADC. <br /> Page 1 <br />
