2 <br /> THE CITY OF <br /> „ "' CITY COUNCIL AGENDA REPORT <br /> pLEASANTON. <br /> January 21, 2014 <br /> City Attorney's Office <br /> TITLE: APPROVE THIRD AMENDMENT TO AGREEMENT WITH JARVIS FAY <br /> DEPORTO & GIBSON FOR LEGAL SERVICES IN CONJUNCTION WITH <br /> PENDING LITIGATION <br /> SUMMARY <br /> The City Attorney's Office previously entered into a legal services agreement with Jarvis <br /> Fay Deporto & Gibson to provide legal services in conjunction with the defense of <br /> pending litigation. That agreement was subsequently extended twice. As the dollar <br /> amount for legal services under this agreement is now in excess of the City Attorney's <br /> authority, the third amendment to the agreement is presented to the City Council for <br /> approval. <br /> RECOMMENDATION <br /> Approve the third amendment to agreement with Jarvis Fay Deporto & Gibson for legal <br /> services in conjunction with pending litigation in an amount not to exceed $175,000 and <br /> an appropriation of funds for this purpose in the amount of$75,000. <br /> FINANCIAL STATEMENT <br /> This litigation is not covered by the City's liability insurance pool. There currently are <br /> not sufficient funds in the City Attorney's Office budget to cover this defense, and <br /> therefore, the additional funding of $75,000 will come from the General Fund <br /> contingency. <br />
