ATTACHMENT 1 <br /> THIRD AMENDMENT TO AGREEMENT <br /> This Third Amendment to Agreement ("Third Amendment") is entered into this 4th day of December <br /> 2013 by the City of Pleasanton("City") and BKF Engineers ("Consultant") <br /> Whereas, on September 7, 2010 the City and Consultant entered into an Agreement for <br /> Professional Services ("Agreement") for the Bernal Avenue at I-680 Interchange Project(Agreement 10- <br /> 685C); and <br /> Whereas, on December 16, 2011 the City and Consultant entered into a First Amendment to the <br /> Agreement for Professional Services to extend the contract expiration date to December 31, 2012; and <br /> Whereas, on March 28, 2013 the City and Consultant entered into a Second Amendment to the <br /> Agreement for Professional Services to extend the contract expiration date to December 31, 2013; and <br /> Whereas,the Consultant's assistance is required to perform an archaeological test program prior <br /> to the start of construction for the I-680 at Bernal Avenue Interchange; additional field survey and <br /> design work is required to revise and finalize the plans, specifications and estimates due to expansion of <br /> the work plan; assistance is required during the advertising and bidding period in order to respond to <br /> questions from the contractors, and assist City staff in preparing contract addenda; and additional time is <br /> needed to complete the Bernal Interchange at I-680 project; and <br /> Whereas,the parties desire to amend to the Agreement; <br /> Now, therefore, the parties agree as follows: <br /> 1. Section 1 of the Agreement is amended to expand the scope of services for the I-680 at <br /> Bernal Avenue Interchange to include an initial archaeological test program prior to the <br /> start of construction; additional survey and design work to revise the plans, specifications <br /> and estimates due to the expansion of the work plan; and services during the advertising <br /> and bidding period to respond to questions from contractors and assist the City in <br /> preparing contract addenda as needed. <br /> 2. Section 4 of the Agreement is amended to increase compensation by$74,400, for a total <br /> compensation amount of$372,066. <br /> 3. The expiration date listed under Section 3 "Terms" of the Agreement shall be extended to <br /> December 31, 2014. <br /> 4. All other terms and conditions of the Agreement shall remain in full force and effect. <br /> BKF Engineers Third Amendment Page 1 <br />
