ATTACHMENT 2 <br /> FOURTH AMENDMENT TO AGREEMENT <br /> This Fourth Amendment to Agreement("Fourth Amendment") is entered into this 17th day of <br /> December, 2013,by the City of Pleasanton("City") and BKF Engineers ("Consultant") <br /> Whereas, on September 7, 2010 the City and Consultant entered into an Agreement for <br /> Professional Services ("Agreement") for the Bernal at I-680 Interchange project (Agreement 10-685C); <br /> and <br /> Whereas, on December 16, 2011 the City and Consultant entered into a First Amendment to the <br /> Agreement for Professional Services to extend the contract expiration date to December 31, 2012; and <br /> Whereas, on March 28, 2013 the City and Consultant entered into a Second Amendment to the <br /> Agreement for Professional Services to extend the contract expiration date to December 31, 2013; and <br /> Whereas, on December 4, 2013 the City and Consultant entered into a Third Amendment to the <br /> Agreement for Professional Services to expand the work plan to include an initial archaeological test <br /> program prior to the start of construction; additional survey and design work to revise the plans, <br /> specifications and estimates due to the expansion of the work plan; services during the advertising and <br /> bidding period to respond to questions from contractors and assist the City in preparing contract addenda <br /> as needed; and extend the contract expiration date to December 31, 2014; and <br /> Whereas,the project work plan was expanded and will require structural and geotechnical <br /> consultation, and additional design details to finalize the plans, specifications and estimates for the <br /> landscape and gateway elements for the I-680 at Bernal Avenue Interchange; process and obtain a <br /> Caltrans encroachment permit rider to construct the landscaping and gateway elements; and assistance is <br /> required during the advertising and bidding period in order to respond to questions from the contractors, <br /> and assist City staff in preparing contract addenda; and <br /> Whereas,the parties desire to amend to the Agreement; <br /> Now, therefore, the parties agree as follows: <br /> 1. Section 1 of the Agreement is amended to expand the work plan for the I-680 at Bernal <br /> Avenue Interchange to finalize the plans, specifications and estimates for landscape and <br /> gateway elements; process and obtain a Caltrans encroachment permit rider to construct <br /> the landscaping and gateway elements; and provide services during the advertising and <br /> bidding period to respond to questions from contractors and assist the City in preparing <br /> contract addenda as needed. <br /> 2. Section 4 of the Agreement is amended to increase compensation by$77,000, for a total <br /> compensation amount of$449,066. <br /> 3.
