ORDINANCE NO. 2084 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF THE HACIENDA OWNERS <br /> ASSOCIATION FOR AN EXTENSION OF ITS DEVELOPMENT AGREEMENTS <br /> FOR AN ADDITIONAL FIVE YEARS REGARDING HACIENDA PHASE I AND <br /> HACIENDA PHASE II, AS FILED UNDER CASE P13-2191 <br /> WHEREAS, Hacienda Owners Association (James Paxson) has applied for an <br /> extension of the Development Agreements for Hacienda Phase I and Hacienda Phase II <br /> for an additional five years, as filed under Case P13-2191; and <br /> WHEREAS, after public notice, on October 9, 2013, the Planning Commission <br /> held a hearing and recommended approval of the extension of the Development <br /> Agreements for Hacienda Phase I and Hacienda Phase II; and <br /> WHEREAS, at its meeting of November 5, 2013 the City Council reviewed the <br /> staff report from the Director of Community Development and Planning Commission <br /> recommendation regarding this matter; and <br /> WHEREAS, on November 5, 2013, a duly-noticed public hearing was held by the <br /> City Council, at which time the applicant and members of the public were offered an <br /> opportunity to present evidence regarding the extension of the development <br /> agreements. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council finds that the Supplemental Environmental Impact <br /> Report (SEIR) prepared and certified on January 4, 2012 for the Housing Element <br /> update and Climate Action Plan General Plan Amendments and Rezonings that <br /> supplemented the Environmental Impact Report (EIR) prepared for the Pleasanton <br /> 2005-2025 General Plan, certified in July 2009 anticipated completion of Hacienda <br /> Phase I and Hacienda Phase II. The California Environmental Quality Act (CEQA) <br /> specifies that individual development projects that are covered by a certified EIR or <br /> SEIR are exempt from additional environmental review, therefore there is no additional <br /> environmental document regarding this extension of the Development Agreements. <br /> SECTION 2. The City Council finds that the proposed extension of the <br /> development agreements is consistent with the City's General Plan for the reasons set <br /> forth in the staff report. <br /> SECTION 3. The City Council approves the extension of the Development <br /> Agreements between the City of Pleasanton and the Hacienda Owners Association, a <br /> copy of which is attached hereto as Exhibit A and incorporated herein by this reference, <br /> and authorizes the City Manager to sign the extension for the Development Agreements <br /> in generally the form set forth in Exhibit A. <br />
