IMPROVEMENT AGREEMENT <br /> Tract 8139, Roselyn Estates 11 <br /> , ( <br /> This Improvement Agreement("Agreement")is made and entered into this�s day of /116 lh�f—013, <br /> by and between Roselyn Estates LLC("Owner")and the City of Pleasanton,a general law city("City"). <br /> RECITALS <br /> WHEREAS, Owner is the owner of real property commonly known as Tract 8139, Roselyn Estates II, <br /> Pleasanton,CA <br /> WHEREAS,Owner has a City-approved planned unit development plan(PUD-94)and vesting tentative <br /> map for Tract 8139(the"tract")for the development of seven(7)new single family homes(the"site");and <br /> WHEREAS,all or a portion of the area of the vesting tentative map is presented as a"final map" a copy of <br /> said map is on file in the office of the City Engineer;and <br /> WHEREAS,Owner understands that owner must obtain a Right to Enter Letter from adjacent property <br /> owners for any work that takes place outside owner's real property. Said letters must be presented to City prior to <br /> permit issuance of permit for such work;and <br /> WHEREAS, said map and subdivision of land designates streets, easements and public ways for the City, <br /> and Owner proposes to dedicate this land set forth in the final map to the City;and <br /> WHEREAS,Owner chooses to install all public improvements prior to recordation of the Final Map <br /> WHEREAS Owner acknowledges that Owner is undertaking the Work at Owner's own risk because <br /> Owner has not received subdivision approval from the City. Notwithstanding this,Owner still wishes to proceed <br /> with the Work. <br /> Owner further acknowledges that this Agreement in no way limits the City's full reasonable discretion in <br /> the consideration of the subdivision of the Property. <br /> WHEREAS, as a condition precedent to accepting an offer of dedication by Owner,City requires the <br /> improvements of the public ways, installation or extension of certain City services at Owner's expense and certain <br /> protection for the City on behalf of the public;and <br /> WHEREAS,as mitigation measures and conditions of approval for PUD-94 and the tract, Owner must also <br /> construct public and private improvements on the site and public improvements off site. <br /> NOW,THEREFORE, in consideration of the faithful performance of the promises,terms, conditions and <br /> covenants set forth herein by Owner,the parties hereto agree as follows: <br /> 1 . Work. Owner will do or cause to be done and performed the following described work: Improvements <br /> pursuant to plans and project estimates entitled: <br /> A. Improvement Plans for Tract 8139,Roselyn Estates II,prepared by DeBolt Civil Engineering;Estimate for <br /> Tract 8139,dated August 21,2013,prepared by DeBolt Civil Engineering and approved by the City <br /> Engineer and <br /> a. Owner must obtain and keep in effect a valid Storm Water Pollution Prevention Plan(SWPPP)for the <br /> Work on the Property. <br /> Improvement Agreement—Tract 8139 Page 1 of 5 <br />
