Market:Northern California <br /> Cell Site Number:CNU0413 <br /> Search Ring Name:Livermore <br /> Cell Site Name:Livermore(CA) <br /> Fixed Asset Number:10087959 <br /> (g) Lessee and its agents and employees shall not hunt on the Property (including <br /> the Premises) or discharge weapons of any kind while on the Property. <br /> (h) No alcoholic beverages shall be consumed on the Property (including the <br /> Premises). <br /> (i) Lessee shall use the existing access road across the Property to the Premises <br /> and shall not travel any other road on the Property or open fields except in cases of emergency <br /> or with the prior authorization of City Staff. <br /> Q) Lessee shall observe a reasonable speed limit on the Property. <br /> (k) Smoking, use of matches, or open fires shall not be permitted on the Property. <br /> 12. Vegetation. Lessee further agrees that no vegetation, if any, will be damaged and/or <br /> removed during installation or maintenance of the Wireless Telecommunication Facility without <br /> the City's reasonable prior written approval. <br /> 13. Governmental Approvals. Lessee shall, at its sole cost and expense, comply with all <br /> applicable requirements, rules, regulations and environmental documentation pertaining to <br /> Lessee's Wireless Telecommunication Facility and operations to be conducted in the Leased <br /> Areas, including all requirements imposed or permits required by the City of Livermore, County <br /> of Alameda, the State of California and the United States of America. <br /> 14. Possessory Interest Tax. Lessee shall pay all possessory interest taxes, assessments <br /> and other governmental charges of any kind applicable to this Lease Agreement and Lessee's <br /> occupancy of the Leased Areas assessed during the Term of this Lease Agreement. This <br /> obligation continues until such time as this Lease Agreement expires or is terminated and <br /> Lessee no longer has possession of the Leased Areas and has satisfied its obligation to remove <br /> the Wireless Telecommunication Facility and restore the Property to its original condition. <br /> 15. Hazardous Materials. <br /> (a) In addition to the rules and restrictions set forth in this Lease Agreement, Lessee <br /> shall not cause or permit any Hazardous Materials to be permanently stored, used or disposed <br /> of, on or in the Premises without first having obtained City's prior, written approval. If <br /> Hazardous Materials are stored, generated, used or disposed of on or in the Premises without <br /> the City's approval, or if the Premises become contaminated in any manner for which Lessee is <br /> responsible, Lessee shall indemnify and hold City harmless from any and all claims, damages, <br /> fines, judgments, penalties, clean-up costs, liabilities or losses (including without limitation, a <br /> decrease in value of the Premises, Property, and adjacent real property or damages due to <br /> adverse impact on marketing of the Premises), and any and all sums paid for settlement of <br /> claims, attorney's fees, consultant and experts' fees arising during or after the Term and arising <br /> as a result of such Hazardous Discharge or Contamination by Lessee or its employees, agents, <br /> or designated representatives. For purposes of this Lease Agreement, the following terms shall <br /> have the meanings set forth below: <br /> (i) "Hazardous Materials" shall mean any toxic or hazardous wastes, pollutants, <br /> materials or substances, including, without limitation, asbestos, PCB's, petroleum products, <br /> Lease for Installation of Telecommunications Equipment-Final Page 8 <br />
