RESOLUTION NO. 13-643 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, AUTHORIZING DESIGNATED REPRESENTATIVE FOR FINANCIAL ASSISTANCE INVOLVEMENT WITH THE STATE WATER RESOURCES CONTROL BOARD WHEREAS, the City Council of the City of Pleasanton (the "Entity") is the legal authority authorizing the Director of Operations Services (Authorized Representative) or his designee to sign and file, for and on behalf of the Entity, a Financial Assistance Application for a financing agreement from the State Water Resources Control Board for assistance in the development of the City of Pleasanton Recycled Water Program; and WHEREAS, the Entity hereby agrees and further does authorize the Authorized Representative or his designee to certify that the Entity has and will comply with all applicable state statutory and regulatory requirements related to any state grant and/or loan funds received; and WHEREAS, the Authorized Representative or his designee of the Entity is hereby authorized to negotiate and execute a grant and/or loan contract and any amendments or change orders thereto on behalf of the Entity. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The Director of Operations Services or his/her designee is hereby authorized and directed to sign and file, for and on behalf of the Entity, a Financial Assistance Application for a financing agreement from the State Water Resources Control Board for the planning, design and construction of the City of Pleasanton Recycled Water Project (the "Project"). SECTION 2. This Authorized Representative, or his/her designee, is designated to provide the assurances, certifications, and commitments required for the financial assistance application, including executing a financial assistance agreement from the State Water Resources Control Board and any amendments or changes thereto. SECTION 3. The Authorized Representative, or his/her designee, is designated to represent the Entity in carrying out the Entity's responsibilities under the financing agreement, including certifying disbursement requests on behalf of the Entity and compliance with applicable state and federal laws.
