review pursuant to Cal. Pub. Res. Code section 21000 et seq., and is conditioned upon <br /> the Parties' completion of CEQA review. <br /> NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br /> 1. Effective Date. This Agreement shall become operative (the Effective Date), <br /> subject to the completion of CEQA review as set forth in Section 14, upon: (a) <br /> approval and execution by the Parties; and (b) approval and execution of the <br /> DERWA-City Agreement. The Effective Date of this Agreement shall be the latter <br /> of the date by which this Agreement is fully executed or the date on which the <br /> DERWA-City Agreement is fully executed. This Agreement shall automatically <br /> terminate if the DERWA-City Agreement terminates for any reason. <br /> 2. Definitions. For purposes of this Agreement, the following words, terms and <br /> phrases shall have the following meanings when capitalized. Other words, terms <br /> and phrases shall have the same meaning as provided in the Basic Agreement <br /> and appropriate supplements. <br /> a. DERWA — The DSRSD-EBMUD Recycled Water Authority, a Joint Powers <br /> Authority comprised of Dublin San Ramon Services District and East Bay <br /> Municipal Utility District. <br /> b. EBMUD — East Bay Municipal Utility District. <br /> c. Secondary Effluent — The treated wastewater produced by the Regional <br /> Sewerage Facilities owned and operated by the District to treat wastewater for <br /> discharge to LAVMWA, which treated wastewater meets the effluent limitations <br /> and other conditions imposed by the National Pollutant Discharge Elimination <br /> System (NPDES) Permit governing the discharge of wastewater by the <br /> District's Regional Sewerage Facilities. This supersedes the definition set forth <br /> in Section 2.H of the Third Supplemental Agreement. <br /> d. City Secondary Effluent — The Secondary Effluent produced from the <br /> treatment of wastewater that the District receives from City. This supersedes <br /> the definition set forth in Section 2.A of the Third Supplemental Agreement. <br /> e. Recycled Water — Secondary Effluent that is further treated to a quality that <br /> meets or exceeds the requirements for unrestricted use pursuant to Title 22, <br /> Page 3 of 19 <br />
