ATTACHMENT 3 <br /> AGREEMENT TO PROVIDE RECYCLED <br /> WATER TREATMENT AND DELIVERY SERVICES <br /> By and between DERWA and the CITY OF PLEASANTON <br /> This Agreement is entered into this day of , 2013, by and between the <br /> DSRSD-EBMUD Recycled Water Authority, a joint powers authority organized and <br /> existing under Government Code sec. 6500 et seq. (hereinafter "DERWA") and the City <br /> of Pleasanton, a California municipal corporation (hereinafter "Pleasanton" or "City"), for <br /> the purpose of establishing the terms and conditions under which DERWA will provide <br /> Recycled Water treatment and delivery services to the City of Pleasanton. <br /> RECITALS <br /> WHEREAS, California is facing a water supply shortage and the State has <br /> identified the beneficial use of Recycled Water to supplement surface water and <br /> groundwater resources as a key component of a comprehensive solution to assist in <br /> meeting the future water requirements of the State; and <br /> WHEREAS, Alameda County Flood Control and Water Conservation District, <br /> Zone 7, the wholesale water agency for the Dougherty and Livermore-Amador Valleys, <br /> has adopted a water supply master plan that identifies the beneficial use of Recycled <br /> Water for irrigation as a local solution for addressing the State water supply shortage <br /> affecting all Zone 7 water customers; and <br /> WHEREAS, the Parties recognize the benefits of using Recycled Water for a <br /> variety of beneficial uses including landscape irrigation, construction water, <br /> industrial/commercial applications and agricultural irrigation, and acknowledge that such <br /> uses represent efficient management of the water resources of the Tri-Valley area and <br /> reduce the amount of treated wastewater pumped out of the Tri-Valley area for <br /> discharge into San Francisco Bay; and <br /> WHEREAS, the Parties recognize the benefits of collaboration to expand the <br /> use of Recycled Water in the DERWA and Pleasanton service areas; and <br /> WHEREAS, DERWA was created to maximize the amount of Recycled Water <br /> delivered while recovering its costs for a Recycled Water project it has developed to <br /> serve the Dougherty, San Ramon and Livermore-Amador Valleys, and has developed <br /> and constructed, and operates and maintains, a system to produce and distribute <br /> Recycled Water within the DERWA service area; and <br /> WHEREAS, pursuant to the Water Supply Agreement dated 28 July 2003 <br /> between DERWA and the Dublin San Ramon Services District, a Community Services <br /> District ("DSRSD"), DSRSD committed to make available up to 6,420 acre-feet/year <br /> 1 <br />
