accounting system to facilitate calculation of the Recycled Water Pipeline <br /> lease payment due from City. District shall deliver a Recycled Water <br /> Pipeline lease payment invoice to City on or by December 31 of each <br /> calendar year. Within thirty (30) days after District delivers the Recycled <br /> Water Pipeline lease payment invoice, City shall pay to District the full <br /> invoice amount. District shall deposit said lease payments to the Regional <br /> Expansion Fund. <br /> v. LAVWMA. The City Recycled Water Program and the District Recycled <br /> Water Program will result in avoided cost savings associated with the <br /> disposal of treated Secondary Effluent to San Francisco Bay. Similarly, <br /> Recycled Water use in EBMUD's service area delivered via the DERWA <br /> Recycled Water Program will also result in avoided cost savings <br /> associated with the disposal of treated Secondary Effluent to San <br /> Francisco Bay. Accordingly, avoided cost savings shall be credited to the <br /> Parties as follows. <br /> 1. Commencing upon initial Recycled Water deliveries to City by <br /> DERWA, for use at Val Vista Park the District shall pay to the City, <br /> from the District's Regional Enterprise Fund, an amount equal to the <br /> avoided cost of wastewater disposal through the LAVWMA system that <br /> is the result of Recycled Water delivered by the City Recycled Water <br /> Program for beneficial use during the preceding year. <br /> 2. Commencing on the Effective Date of this Fifth Supplemental <br /> Agreement, the District shall, at its option, pay to or credit its Local or <br /> Water Enterprise Fund from its Regional Enterprise Fund, an amount <br /> equal to the avoided cost of wastewater disposal through the LAVWMA <br /> system as the result of Recycled Water delivered by the District <br /> Recycled Water Program during the preceding year. <br /> 3. Commencing on the Effective Date of this Fifth Supplemental <br /> Agreement, the District shall retain in its Regional Enterprise Fund, an <br /> amount equal to the avoided cost of wastewater disposal through the <br /> Page 9 of 19 <br />
