CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA CDUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 876 <br /> <br /> AN ORDINANCE A}~NDING CHAPTER 13 (RESIDENTIAL ALLOCATION <br /> PROGRAM) OF TITLE II OF THE ORDINAJ~CE CODE OF THE CITY <br /> OF PLEASANTON TO PROVIDE FOR EXE~-~TION OF LARGE LOT <br /> SUBDIVISIONS. <br /> <br />WHEREAS, the City Council of the City of Pleasanton desires to <br /> encourage a variety of housing types in the City; and <br /> <br />WHEREAS, the Residential Allocation Program as it is designed <br /> discourages most large-lot residential developments due <br /> to its locational and improvement criteria; and <br /> <br />WHEREAS, exemptions could be made under certain circumstances <br /> without reducing the effectiveness of the Residential <br /> Allocation Program both as a growth control and a <br /> selector of those projects most beneficial to the City; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON ORDAINS <br />AS FOLLOWS: <br /> <br /> Section 1. Chapter 13 (Residential Allocation Program) of Title II <br /> (Zoning and Development) of the Ordinance Code of the City of <br /> Pleasanton Ordinance Code is hereby amended by adding Section 2-20.20, <br /> as follows: <br /> <br /> §2-20.20 Special Exemptions. <br /> Sections 2-20.04 and 2-20.05 notwithstanding, the <br /> Director of Planning and Community Development shall <br /> approve a special exemption from the Residential <br /> Allocation Program for large-lot residential <br /> developments if the proposed development meets all <br /> of the requirements (a-d), below: <br /> <br /> (a) The average lot size for the development <br /> shall be 5 acres (gross) per lot or greater; <br /> (b) The applicant shall pay the maximum contri- <br /> bution per lot to the Capital Improvement Fund, <br /> Housing Fund and any other incentive funds avail- <br /> able in the Residential Allocation Program <br /> selection criteria in effect at the time of the <br /> application for exemption. <br /> (c) The proposal shall meet all of the mandatory <br /> elements of the Residential Allocation Program <br /> selection criteria in effect at the time of the <br /> application for exemption. Where any criterion <br /> cannot be applied at the subdivision level, the <br /> applicant for special exemption shall enter into <br /> an agreement that the houses to be built will <br /> be designed to meet those standards. <br /> (d) The proposal shall be consistent with the <br /> General Plan and conform to the existing zoning. <br /> <br /> <br />
