RESOLUTION NO. 13-641 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE WITHDRAWAL FROM PARTICIPATION IN THE TRI-VALLEY <br /> WATER RETAILERS COOPERATION AGREEMENT <br /> WHEREAS, the City of Pleasanton executed the Tri-Valley Water Retailers Cooperation <br /> Agreement ("Agreement") on April 1, 2003, formed by the City of Livermore and the Dublin San <br /> Ramon Services District on August 22, 2002; and <br /> WHEREAS, on September 27, 2003 the California Water Services Company executed <br /> the Agreement; and <br /> WHEREAS, the four parties to the Agreement, collectively known as the "Retailers," <br /> have successfully carried out the purpose of the Agreement to "...influence Zone 7 decisions <br /> that assure there will be adequate supplies to meet demands in the future;" and <br /> WHEREAS, the Retailers forged a cooperative working relationship with Zone 7 and <br /> now find that the purpose of the Agreement can be more efficiently achieved with the Retailers <br /> and Zone 7 working together; and <br /> WHEREAS, the Retailers intend to meet jointly with Zone 7 on a regular basis at the <br /> policy-maker level as a Joint Liaison Committee to discuss issues of common interest <br /> associated with water supply, water quality, infrastructure and finances; and <br /> WHEREAS, to discuss issues of mutual interest, Retailer staff members will continue to <br /> meet on a regular basis; and <br /> WHEREAS, it is no longer necessary for Pleasanton to operate under the Agreement. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council authorizes City staff to send a letter to the other <br /> Retailers notifying them of the City's withdrawal from participation in the Tri-Valley Retailers <br /> Cooperation Agreement and directs staff to take other actions necessary to complete withdrawal <br /> from the Agreement. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on October 15, 2013. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 15th day of October, <br /> 2013, by the following vote: <br /> Ayes: Councilmembers Brown, Cook-Kallio, Narum, Pentin, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br />
