Section 2. This ordinance shall take effect immediately, pursuant to Government Code §36937(b). The facts constituting the urgency are: The applicants subject to the November 14, 1978. Council action would be materially injured, if not permitted to partici- pate in this year's Residential Allocation Program application. However, to delay the Residential Allocation Program hearing further, to provide for the normal adoption process of ordinances~would unfairly injure the City and the other applicants under the Residential Allocation Program in that (i) the developers need the certainty of knowing they will be able to develop so that they will have time to process other required governmental approvals, secure financing and sign up contractors and sub-contractors, prior to the commencement of the construction season; (ii) the City needs sufficient lead time to prepare for the developments and to coordi- nate such development with the City's capital improvement program, commencing in January, 1979; and (iii) there exists in the City of Pleasanton a low vacancy rate which should be remedied as soon as possible; Residential Allocation Program delay would extend the period of such housing shortage. Section 3. This ordinance shall be published once within fifteen (15) days after its adoption in "THE TIMES," a newspaper of general circulation, published in the City of Pleasanton.
