ORDINANCE NO. 2080 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING CHAPTER 18.84 AND CHAPTER 18.106 OF TITLE 18 OF THE <br /> PLEASANTON MUNICIPAL CODE TO COMPLY WITH THE 2012 PLEASANTON <br /> GENERAL PLAN HOUSING ELEMENT PERTAINING TO SECOND UNITS, AS FILED <br /> UNDER CASE P13-2079 <br /> WHEREAS, there is an identified need for affordable housing for low-income individuals <br /> and families in Pleasanton; and <br /> WHEREAS, second units provide housing for family members, students, the elderly, in- <br /> home care providers, the disabled, and others at below market prices within existing <br /> neighborhoods; and <br /> WHEREAS, Program 6.3 of the 2012 Pleasanton Housing Element calls for measures to <br /> reduce the zoning requirements to promote the creation of second units; and <br /> WHEREAS, pursuant to California Public Resource Code Section 21080.17, the <br /> adoption of an ordinance regarding second units to implement the provisions of California <br /> Government Code Sections 65852.1 and 65852.2, is exempt from the California Environmental <br /> Quality Act; and <br /> WHEREAS, at its meeting of August 16, 2013, the Planning Commission recommended <br /> that the City Council amend Title 18 of the Pleasanton Municipal Code to modify the height <br /> requirements for second units constructed above a detached garage to allow heights up to 25 <br /> feet when setback requirements are met by determining that such height is similar to a single <br /> family home; and <br /> WHEREAS, at its meeting of September 17, 2013, the City Council reviewed the report <br /> of the Director of Community Development and the recommendations of the Planning <br /> Commission regarding amendment of Title 18 of the Pleasanton Municipal Code regarding <br /> second units. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council finds that the proposed amendments to the Pleasanton <br /> Municipal Code are exempt from further environmental review pursuant to California Public <br /> Resources Code Section 21080.17, and are consistent with the Pleasanton General Plan. <br /> SECTION 2. It amends Title 18 of the Pleasanton Municipal Code to read as set forth <br /> in Exhibit A, attached hereto and incorporated herein by this reference. <br /> SECTION 3. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br /> City Clerk's office within fifteen (15) days after its adoption. <br /> 1 <br />
