ORDINANCE NO. 2078 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF PLEASANTON GATEWAY, L.L.C., FOR <br /> PLANNED UNIT DEVELOPMENT (PUD) PLAN APPROVAL, AS FILED <br /> UNDER CASE PUD-96 <br /> WHEREAS, Pleasanton Gateway, L.L.C., has applied for Planned Unit <br /> Development Plan approval to construct 210 apartment units, 97 single-family detached <br /> units, and related on- and off-site improvements on an approximately 26.72-acre site <br /> located at 1600 Valley Avenue (the "Project" or "PUD-96"); and <br /> WHEREAS, zoning for the property is Planned Unit Development— High Density <br /> Residential (PUD-HDR) and Planned Unit Development — Medium Density Residential <br /> (PUD-MDR); and <br /> WHEREAS, at its August 14, 2013 meeting, the Planning Commission adopted <br /> Resolution No. PC-2013-41, determining that the proposed development plan is <br /> appropriate for the site, making findings, and recommending to the Pleasanton City <br /> Council that PUD-96 be approved; and <br /> WHEREAS, on September 3, 2013, the Pleasanton City Council held a duly <br /> noticed public hearing on this application and considered all public testimony, agenda <br /> reports, and related materials, and the recommendations of City staff and the Planning <br /> Commission; and <br /> WHEREAS, the City Council finds that the exceptions to the Housing Site <br /> Development Standards and Design Guidelines as stated on page 13 of the August 14, <br /> 2013, Planning Commission staff report are appropriate; and <br /> WHEREAS, the City Council determined that the conditions described in <br /> California Environmental Quality Act (CEQA) Guidelines Section 15162 have not <br /> occurred and found that the previously prepared Supplemental Environmental Impact <br /> Report (SEIR), including the adopted CEQA Findings and Statement of Overriding <br /> Considerations in City Council Resolution 12-492, and the Addendum to the SEIR for <br /> the Project are adequate to serve as the environmental documentation for the Project <br /> and satisfy all the requirements of CEQA; and <br /> WHEREAS, the Pleasanton City Council finds that the proposed PUD <br /> development plan is consistent with the City's General Plan and purposes of the PUD <br /> ordinance, and by this reference adopts and reaffirms all of the considerations and <br /> findings set forth in Planning Commission Resolution No. PC-2013-41. <br /> Page 1 <br />
