CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> ORDINANCE NO. 870 <br /> <br /> AN ORDINANCE MODIFYING THE UNIFORM BUILDING CODE TO <br /> REQUIRE THE INSTALLATION OF SMOKE DETECTORS IN <br /> EXISTING RESIDENTIAL UNITS AT TIME OF SALE. <br /> <br /> WHEREAS, the 1976 Building Code requires the installation of smoke <br /> detectors in new residential units~ and <br /> WHEREASi!t~he prob~iem of fire safety in the City of Pleasanton in <br /> existing residential units appears to exist due to the <br /> recent number of fire fatalities in the City; and <br /> <br /> WHEREAS, the safety of residents of existing buildings could be <br /> increased by requiring the installation of smoke detectors <br /> in those buildings; and <br /> <br /> WHEREAS, the sale of a residential property provides a reasonable <br /> time for requiring installation of such smoke detectors; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON ORDAINS <br /> AS FOLLOWS: <br /> <br /> Section 1. Section 2-12.36 (Amendments, Modifications, Additions <br /> to and Deletions from the Adopted Code) of Article 1 <br /> (Adoption of Uniform Building Code with Deletions and <br /> Modifications), of Chapter 3 (Building Codes), Title II <br /> (Zoning and Development) of the Pleasanton Ordinance <br /> Code is hereby amended by adding subparagraph (b)(3) as <br /> follows: <br /> <br /> 3. Section 104(k) is hereby added to the Code to <br /> read as follows: <br /> <br /> "No residential property may be sold or <br /> traded in the City of Pleasantonunless <br /> and until the seller installs or provides <br /> for the installation of smoke detectors <br /> in accordance with Section 1310a or Sec- <br /> tion 1413, as applicable. This require- <br /> ment may be met by the seller placing in <br /> the escrow account for the use of the <br /> buyer sufficient funds to pay for said <br /> installation." <br /> <br />Section 2. This ordinance shall be filed with the findings attached <br /> hereto with the State Department of Housing and be made <br /> available to the public pursuant to Section 17958.7 of <br /> the Health and Safety Code. <br /> <br />Section 3. This ordinance shall become effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> <br />Section 4. This ordinance shall be published once within fifteen <br /> (15) days after its adoption in "THE TIMES," a newspaper <br /> of general circulation, published in the City of Pleasanton. <br />//// <br /> <br /> <br />
