1 ) <br /> 12 . ENTRY UPON RESIDENT ' S SPACE. Park has the right of <br /> entry upon the premises to maintain utilities or in case of <br /> emergency. Park may charge a reasonable fee for services <br /> relating to maintenance of the land and premises upon which a <br /> mobilehome is situated if Resident fails to maintain the land and <br /> premises in accordance with park Rules and Regulations after <br /> written notice to Resident and Resident ' s failure to comply <br /> within fourteen ( 14 ) days . <br /> 13 . TERMINATION OF TENANCY. The tenancy created hereby may <br /> be terminated by the Resident upon the giving of written notice <br /> to the Park not less than sixty (60) days before vacating the <br /> tenancy. The Park may terminate the tenancy only in accordance <br /> with the provisions of the Mobilehome Residency Law. <br /> 14 . REMOVAL ON SALE. Resident may resell at any time the <br /> Resident ' s mobilehome upon certain conditions as set forth in <br /> this Lease and the attached Rules and Regulations. The Park may <br /> however, at its option, exercise its rights under the Mobilehome <br /> Residency Law to require removal of the mobilehome upon resale to <br /> a third party, under the conditions specified in the Mobilehome <br /> Residency Law. <br /> 15 . ASSIGNMENT OR SUBLETTING. Resident may freely assign <br /> this Lease to any person approved in writing by Park. Such <br /> approval may be obtained by the submission by each potential <br /> assignee of an application for tenancy to Park in such form a <br /> Park may from time to time have in use . Each such application <br /> will be reviewed by Park, and a determination of approval or <br /> rejection will be made in accordance with the requirements of the <br /> California Civil Code, Mobilehome Residency Law, Section 798 . 74, <br /> or any statute replacing that Section. Upon approval of such <br /> application and acceptance of such assignment by the assignee, <br /> Resident shall have no further responsibility to Park beyond the <br /> date of the assignment . <br /> Except as provided in Civil Code, Section 798 . 23 . 5, no <br /> subleasing or renting of Resident ' s mobilehome or homesite is <br /> permitted. <br /> 16. USE PROHIBITED. Except as provided in Civil Code, <br /> Section 798 . 34, Resident shall not use or permit the premises or <br /> any part thereof to be used for any purpose other than a <br /> residence for the persons on page 6. No other person may make <br /> his or her permanent residence at the premises without the prior <br /> written consent of the Park. Such consent may be granted or <br /> withheld in the Park' s sole discretion and depending upon <br /> availability of existing facilities to handle the number of <br /> permanent Residents in the Park. Residency shall consist of <br /> occupancy in excess of thirty (30) days in any calendar year. <br /> - 4 - - <br />
