TERMINATION FOR CAUSE <br /> If the City finds the Property Owner has not complied in a material respect with the terms <br /> and conditions of this Agreement, the City shall provide written notice to the Property Owner <br /> describing (1) such failure to comply with the terms and conditions of the Agreement ("Default") <br /> and (2) the actions required by the Property Owner to cure such Default. The Property Owner <br /> shall have 60 days after the date of such notice to cure the Default or, if the Default is such that it <br /> cannot be cured within the 60 day period, the Property Owner shall have commenced the actions <br /> necessary to cure such Default and shall be diligently proceeding to complete such actions <br /> necessary to cure such Default within 60 days from the date of the notice. The Property Owner's <br /> failure to cure or pursue the cure of the Default as set forth above shall constitute grounds for <br /> termination of this Agreement. Unless replaced by a successor agreement, the termination of this <br /> Agreement shall result in the immediate applicability of Chapter 6.60 (Mobilehome Space Rents) <br /> of the Pleasanton Municipal Code to the Park and rents charged for spaces therein. <br /> XVII. NO RETALIATION <br /> There shall be no retaliation against any participant in the proceedings leading up to this <br /> Agreement nor shall there be any retaliation against any person who exercises rights pursuant to <br /> this Agreement. <br /> XVIII.ATTORNEY'S FEES <br /> In the event that it becomes necessary for any party to bring a lawsuit to enforce any of <br /> the provisions of this Agreement, a court of competent jurisdiction may determine and fix a <br /> reasonable attorney's fee to be paid the prevailing party. <br /> Agreement Providing for Stabilization of Mobilehome Space Rents <br /> October 1,2013 <br /> 11 <br />
