EXHIBIT A <br /> Proposed Code Amendment <br /> Adding a New Chapter 17.38 (Density Bonus) to Title 17 of the Pleasanton <br /> Municipal Code <br /> 2. A power exists in the association to enforce an obligation of an owner <br /> of a separate interest with respect to the beneficial use and enjoyment <br /> of the common area by means of an assessment which may become a <br /> lien upon the separate interests. <br /> Q. "Senior citizen housing development" means a residential development <br /> developed, substantially rehabilitated, or substantially renovated for, senior <br /> citizens that has at least 35 dwelling units, as defined in the California Civil <br /> Code Section 51.3, or a mobile home park that limits residency based on <br /> age requirements for housing for older persons pursuant to California Civil <br /> Code Sections 798.76 or 799.5. <br /> R. "Target unit" means a dwelling unit within a housing development which will <br /> be reserved for sale or rent to, and is made available at an affordable rent <br /> or affordable ownership cost to very low, low or moderate income <br /> households, or is a unit in a senior citizen housing development. <br /> S. "Very low income household" means households whose income does not <br /> exceed the very low income limits applicable to Alameda County, as <br /> published and periodically updated by the State Department of Housing and <br /> Community Development pursuant to California Health & Safety Code <br /> Section 50105. <br /> 17.38.030 Eligibility. <br /> An applicant proposing a housing development of five or more dwelling units may <br /> request and be eligible for one density bonus and one or more incentives or <br /> concessions provided the applicant agrees to construct one of the following: <br /> A. At least ten percent of the total units of a housing development for low <br /> income households; or <br /> B. At least five percent of the total units of a housing development for very low <br /> income households; or <br /> C. A senior citizen housing development; or <br /> D. At least ten percent of the total dwelling units in a newly constructed <br /> common interest development for sale to moderate income households. <br /> 17.38.040 Calculation of Density Bonus <br /> A. Each housing development is entitled to one density bonus, which may be <br /> selected from one of the four eligibility criteria established in Section <br /> 17.38.030.
