5 <br /> ORDINANCE NO. 2081 <br /> AN ORDINANCE APPROVING AN APPLICATION FOR A PLANNED UNIT <br /> DEVELOPMENT (PUD) MAJOR MODIFICATION TO THE APPROVED PUDS <br /> (PUD-81-30 AND PUD-85-08) GOVERNING HACIENDA BUSINESS PARK TO <br /> ADDRESS RESIDENTIAL DEVELOPMENT AND HOW IT AFFECTS THE <br /> DEVELOPABLE SQUARE FOOTAGE IN HACIENDA BUSINESS PARK (HACIENDA), <br /> AS FILED UNDER CASE NOS. PUD-81-30-55M AND PUD-85-08-27M <br /> WHEREAS, the City of Pleasanton applied for a Planned Unit Development (PUD) Major <br /> Modification to address residential development and how it affects the developable square <br /> footage in Hacienda Business Park; and <br /> WHEREAS, at its meeting of August 28, 2013, the Planning Commission held a noticed <br /> public hearing and considered all public testimony, relevant exhibits, and recommendations of <br /> City staff concerning the application, and recommended approval of the PUD Major Modification <br /> and amendment of Condition of Approval No. 2.D. of City Council Ordinance No. 1596 to <br /> exclude seven specific sites from the total gross floor area within Hacienda; and <br /> WHEREAS, a duly noticed public hearing was held on September 17, 2013, where the <br /> City Council received a report from the Director of Community Development regarding this <br /> application; and <br /> WHEREAS, at the public hearing on September 17, 2013, the applicant and other <br /> members of the public were offered an opportunity to present evidence regarding the <br /> application; and <br /> WHEREAS, the City Council determined that the conditions described in California <br /> Environmental Quality Act (CEQA) Guidelines Section 15162 have not occurred and found that <br /> the previously prepared Supplemental Environmental Impact Report (SEIR), including the <br /> adopted CEQA Findings and Statement of Overriding Considerations in City Council Resolution <br /> 12-492, are adequate to serve as the environmental documentation for the Project and satisfy <br /> all the requirements of CEQA; and <br /> WHEREAS, the Pleasanton City Council finds that the proposed amendment to the PUD <br /> is consistent with the City's General Plan and purposes of the PUD ordinance; and <br /> WHEREAS, The City Council finds that based on substantial evidence the conditions <br /> described in California Environmental Quality Act (CEQA) Guidelines §15162 have not occurred <br /> and finds that the previously prepared Supplemental Environmental Impact Report (SEIR) for <br /> the City of Pleasanton Housing Element and Climate Action Plan (to supplement the City of <br /> Pleasanton's 2005-2025 General Plan EIR certified in 2009), including the adopted Findings <br /> and Statement of Overriding Considerations in City Council Resolution 12-492 are adequate to <br /> serve as the environmental documentation for this Project and satisfy all the requirements of <br /> CEQA; and <br /> WHEREAS, at the public hearing on September 17, 2013, the City Council, after a <br /> review of the materials presented, approved the City's application to amend Condition of <br /> Approval No. 2.D. of City Council Ordinance No. 1596 to exclude the seven sites shown on the <br /> attached Exhibit B from the total gross floor area within Hacienda. <br />
