project footprint to prohibit project activity from entering into the buffer area for a <br /> time period appropriate for the species, as set forth by the qualified biologist. <br /> The exclusionary fencing shall remain in place until the qualified biologist <br /> confirms that the young have fledged. All required buffers shall be shown on <br /> construction plans and submitted to the City. If construction activities or tree <br /> removal are proposed to occur during the non-breeding season (September- <br /> January), a survey would not be required, nor any further studies or mitigation. <br /> 50. The applicant shall hire a qualified biologist to conduct a bat survey and identify <br /> measures, if any, in the construction plan(s) to reduce impacts to bats and their <br /> roosts consistent for large trees and vacant buildings that are to be removed. If <br /> active day or night roosts are found, the bat biologist shall take actions to make <br /> such roosts unsuitable habitat prior to tree removal or building demolition. A no- <br /> disturbance buffer of 100-feet shall be created around active bat roosts being <br /> used for maternity or hibernation purposes. Bat roosts initiated during <br /> construction are presumed to be unaffected, and no buffer shall be required. <br /> Engineering Division <br /> 51. the applicant shall pay its pro-rata share of the City's Capital Improvement <br /> Project (CIP) to reconstruct Stanley Boulevard along the project frontage, project <br /> frontage being the farthest eastern point of Lot 12 extending to the farthest <br /> western point of Lot 13, at the rate of$838.07 per linear foot prior to the approval <br /> of a final map or at a later time approved by the Community Development <br /> Director. <br /> 52. Should the applicant's project precede the City's CIP to reconstruct Stanley <br /> Boulevard, the applicant shall be required to construct interim street <br /> improvements. The interim improvements shall consist of curb, gutter and <br /> sidewalk and shall begin from the farthest eastern point of Lot 12 and extend to <br /> the west and connect to the existing curb, gutter and sidewalk located on the <br /> west side of the property at 4224 Stanley Boulevard. The exact layout of the tie- <br /> in shall be shown on the improvement plans submitted to the Building and Safety <br /> Division for plan check and permit issuance and subject to the review and <br /> approval of the City Engineer prior to issuance of a building permit. <br /> 53. If it can be demonstrated to the satisfaction of the City Engineer that the street <br /> improvements constructed as a part of the project can be retained and tie into the <br /> City's CIP for Stanley Boulevard, the pro-rata share amount noted in condition of <br /> approval No. 52 shall be adjusted accordingly and condition of approval No. 53, <br /> shall not apply. The improvements (i.e., curb, gutter, sidewalk) shall be installed <br /> from the farthest easterly point of Lot 12 and extend to the west curb return at the <br /> intersection of Stanley and Santa Rita Road unless otherwise approved by the <br /> City Engineer. <br /> 54. The applicant will be required to install a valley gutter between Stanley Boulevard <br /> and the in-tract street. The valley gutter shall be shown on the improvement <br /> 13-Unite Development Plan Ponderosa Homes <br /> PUD-97, Conditions of Approval 12 of 32 4202 Stanley Boulevard <br />
