RESOLUTION NO. 13-638 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF <br /> PLEASANTON AND PLEASANTON GATEWAY, L.L.C., AS FILED UNDER CASE <br /> NO. PUD-96. <br /> WHEREAS, the City has approved Pleasanton Gateway, L.L.C.'s application for <br /> Planned Unit Development Plan approval to construct 210 apartment units, 97 single- <br /> family detached units, and related on- and off-site improvements on an approximately <br /> 26.72-acre site located at 1600 Valley Avenue (the "Project" or "PUD-96"); and <br /> WHEREAS, Pleasanton Gateway, L.L.C., has made an application to the City for <br /> an Affordable Housing Agreement for the Project; and <br /> WHEREAS, the Pleasanton Housing Commission reviewed the Affordable <br /> Housing Agreement at its duly-noticed public hearing of July 23, 2013; and <br /> WHEREAS, a duly-noticed public hearing was held by the City Council on <br /> September 3, 2013, at which time the public was given the opportunity to comment on <br /> the Affordable Housing Agreement; and <br /> WHEREAS, the City Council considered all the information presented at the <br /> public hearing regarding the terms of the Affordable Housing Agreement. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. It finds that the proposed Affordable Housing Agreement between the <br /> City of Pleasanton and Pleasanton Gateway, L.L.C., is consistent with the City's General <br /> Plan and the objectives of the City's affordable housing polices. <br /> SECTION 2. It approves the Affordable Housing Agreement between the City of <br /> Pleasanton and Pleasanton Gateway, L.L.C., a copy of which is attached hereto as <br /> Exhibit A and incorporated herein by this reference; and authorizes the City Manager to <br /> execute the Affordable Housing Agreement in generally the form attached as Exhibit A. <br /> SECTION 3. This resolution shall become effective immediately upon the <br /> effective date of the ordinances approving the PUD development plan and development <br /> agreement for this project. <br /> 1 <br />
