ATTACHMENT 1 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADDING CHAPTER 17.38 TO TITLE 17 OF THE PLEASANTON MUNICIPAL CODE TO COMPLY WITH THE 2012 PLEASANTON GENERAL PLAN HOUSING ELEMENT AND STATE DENSITY BONUS LAW, AS FILED UNDER CASE P13 -2102. WHEREAS, there is an identified need for affordable housing for low- income individuals and families in Pleasanton; and WHEREAS, Program 9.6 of the 2012 Pleasanton Housing Element prescribes that a density bonus ordinance be adopted to support development of affordable housing; and WHEREAS, California Government Code Sections 65915 -65918 establishe State Density Bonus Law, which requires that cities and counties adopt an ordinance specifying how they will comply with and implement the law; and WHEREAS, a code amendment has been prepared which is consistent with and in compliance with State Density Bonus Law; and WHEREAS, a Supplemental Environmental Impact Report prepared for the 2012 Pleasanton Housing Element was certified by the City Council on January 4, 2012, and the proposed code amendment, being consistent with the 2012 Pleasanton Housing Element, requires no additional environmental review; and WHEREAS, at its meeting of August 28, 2013, the Planning Commission recommended that the City Council add Chapter 17.38 to Title 17 of the Pleasanton Municipal Code to establish provisions for density bonuses; and WHEREAS, at its meeting of September 17, 2013, the City Council reviewed the report of the Director of Community Development and the recommendations of the Planning Commission regarding adding Chapter 17.38 to Title 17 of the Pleasanton Municipal Code regarding density bonuses. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds that the proposed amendment of the Pleasanton Municipal Code is consistent with the previously certified Supplemental Environmental Impact Report prepared for the 2012 Pleasanton Housing Element, and with the Pleasanton General Plan. SECTION 2. Adopts the new Chapter 17.38 of Title 17 of the Pleasanton Municipal Code addressing density bonus as set forth in Exhibit A, attached hereto and incorporated herein by this reference.
