ATTACHMENT 1 <br />ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />AMENDING CHAPTER 18.84 AND CHAPTER 18.106 OF TITLE 18 OF THE <br />PLEASANTON MUNICIPAL CODE TO COMPLY WITH THE 2012 PLEASANTON <br />GENERAL PLAN HOUSING ELEMENT PERTAINING TO SECOND UNITS, AS FILED <br />UNDER CASE P13 -2079. <br />WHEREAS, there is an identified need for affordable housing for low- income <br />individuals and families in Pleasanton; and <br />WHEREAS, second units provide housing for family members, students, the <br />elderly, in -home care providers, the disabled, and others at below market prices within <br />existing neighborhoods; and <br />WHEREAS, Program 6.3 of the 2012 Pleasanton Housing Element calls for <br />measures to reduce the zoning requirements to promote the creation of second units; <br />and <br />WHEREAS, pursuant to California Public Resource Code Section 21080.17, the <br />adoption of an ordinance regarding second units to implement the provisions of <br />California Government Code Sections 65852.1 and 65852.2, is exempt from the <br />California Environmental Quality Act; and <br />WHEREAS, at its meeting of August 16, 2013, the Planning Commission <br />recommended that the City Council amend Title 18 of the Pleasanton Municipal Code to <br />modify the height requirements for second units constructed above a detached garage <br />to allow heights up to 25 feet when setback requirements are met by determining that <br />such height is similar to a single family home; and <br />WHEREAS, at its meeting of September 17, 2013, the City Council reviewed the <br />report of the Director of Community Development and the recommendations of the <br />Planning Commission regarding amendment of Title 18 of the Pleasanton Municipal <br />Code regarding second units. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. The City Council finds that the proposed amendments to the <br />Pleasanton Municipal Code are exempt from further environmental review pursuant to <br />California Public Resources Code Section 21080.17, and are consistent with the <br />Pleasanton General Plan. <br />SECTION 2. Amends Title 18 of the Pleasanton Municipal Code addressing the <br />development of second units as set forth in Exhibit A, attached hereto and incorporated <br />herein by this reference. <br />
