Assignment to Crowe Horwath, LLP <br />Section 10 of the current agreement stipulates that the consultant may not <br />assign, sublet, or transfer the agreement without approval of the City. NewPoint <br />recently informed the City that Crowe Horwath, LLP now employs all former <br />NewPoint Group personnel and as such, it is requesting an assignment of the <br />agreement. To date staff has worked primarily with Erik Nylund on this project <br />and we have been informed that he will continue to be assigned as the City's <br />primary consultant. No operational, billing or other matters are anticipated to <br />change as a result of this assignment. <br />Amendment Number One <br />In November 2012 as a partial outcome of the PGS rate adjustment, the City <br />Council approved Amendment Number One to the Agreement with NewPoint for <br />a maximum amount of $20,000 to assist with a review of the Franchise and its <br />rate setting methodology. The City Council Subcommittee, staff, and the <br />consultant have been engaged in this process and negotiations are ongoing. To <br />date, NewPoint has billed the City a total of $15,345 for its work and based on <br />progress to date, staff assumes that the $20,000 fee anticipated in the <br />amendment will be inadequate to complete the project.
