ROLL CALL <br /> Present: Councilmembers Brown, Cook-Kallio, Narum, Pentin, Mayor Throne <br /> Absent: None <br /> 3. PUBLIC COMMENT: None <br /> 4. ADJOURN TO CLOSED SESSION <br /> The meeting adjourned to closed session for the following: <br /> (a) Conference with Legal Counsel — Anticipated Litigation, Significant exposure to litigation <br /> pursuant to paragraph (2) of subdivision (d) of Government Code section 54956.9: Potentially <br /> 1 to 5 matters <br /> (b) Conference with Legal Counsel — Existing Litigation, pursuant to Government Code section <br /> 54956.9(a): Claimant: Paul Chenkovich — Worker's Compensation Appeals Board <br /> #ADJ7518718 <br /> 5. RECONVENE IN OPEN SESSION <br /> The Council reconvened in Open Session at 6:00 p.m. <br /> City Attorney Lowell reported the Council met in Closed Session to discuss anticipated litigation as <br /> well as existing litigation related to the claims of Paul Chenkovich and Ron Gertin. In all matters, no <br /> reportable action was taken. <br /> 6. PUBLIC HEARINGS (6:00 PM) <br /> (a) Public Hearing: PUD-87 and P13-1981 Sares Regis/E&S Ring — Consider (1) introduction of <br /> an ordinance approving a Planned Unit Development (PUD) Development Plan to construct <br /> 345 apartment units, an approximately 38,781 sq. ft. retail center consisting of four buildings, <br /> a new surface parking, and related site improvements on approximately 16 acres located at <br /> 3150 Bernal Avenue (southeast corner of Bernal Avenue and Stanley Boulevard); (2) <br /> introduction of an ordinance approving a Development Agreement; (3) an Affordable Housing <br /> Agreement; and (4) a Growth Management Agreement <br /> Community Development Director Dolan presented the staff report, stating the proposed project site at <br /> 3150 Bernal Avenue is one of several sites rezoned for mixed-use development as part of the recent <br /> Housing Element update. The project site encompasses 16 acres, 11.5 of which is dedicated to <br /> residential development and 4.5 of which is dedicated to retail development. The applicant proposes to <br /> develop a total of 345 apartment units across 3 fairly distinct clusters with an overall density of 30 units <br /> per acre.
