EXHIBIT D <br /> TO <br /> DEVELOPMENT AGREEMENT <br /> FOR AUF DER MAUR/RICKENBACH SITE <br /> PARTIAL LIST OF PERMITTED RETAIL USES <br /> The uses for the Planned Unit Development — Commercial (PUD-C) zoned portion of the <br /> property shall be the permitted and conditionally permitted uses of the C-N (Neighborhood- <br /> Commercial) District. <br /> Notwithstanding the permitted and conditionally permitted uses in the C-N District, the <br /> following use shall be prohibited on the Planned Unit Development — Commercial (PUD-C) <br /> zoned portion of the property: <br /> a. Tobacco stores <br /> Notwithstanding the permitted and conditionally permitted uses in the C-N District, the <br /> following uses shall be permitted on the Planned Unit Development — Commercial (PUD-C) <br /> zoned portion of the property: <br /> a. Building materials sales, including showrooms, shops, and stores with <br /> ancillary design services and indoor display and storage only. <br /> b. Carpet, drapery and floor-covering stores, with design services. <br /> c. Gymnasiums and health clubs including massage services of three or fewer <br /> massage technicians at any one time. Massage establishments within <br /> gymnasiums and health clubs shall meet the requirements of Chapter 6.24. <br /> This use is limited to individual tenant spaces less than 5,000-square-feet in <br /> buildings identified as Retail Shops 1 and Retail Shops 2 on Exhibit B. <br /> d. Food market including supermarkets, convenience markets and specialty <br /> stores. The hours of operation for a convenience market shall be limited to <br /> 5:00 a.m. to 11:00 p.m. <br /> e. Drugstore and prescription pharmacies with 24-hour drive-through operation. <br /> Drive-through sales shall be limited to prescription medications only. <br /> £ Furniture stores <br /> g. Interior decorator shops and design services, including showrooms <br /> h. Electronic retail sales with no repair services, of telephones, pagers, cellular <br /> telephones, personal computers and software, televisions, radios, stereos, and <br /> similar items <br /> i. Kitchen supply stores and accessories with ancillary demonstration, classes, <br /> and cutlery sharpening. <br /> j. Medical offices including dental, optometry, chiropractic and other such uses <br /> typically found in neighborhood shopping centers. Total square footage of <br /> medical office tenants in the subject shopping center shall not exceed 5,000 <br /> square feet. <br /> k.
