ORDINANCE NO. 2075 <br /> AN ORDINANCE OF THE CITY OF PLEASANTON APPROVING THE APPLICATION <br /> OF RING FINANCIAL, INC. FOR PLANNED UNIT DEVELOPMENT (PUD) <br /> DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-87 <br /> WHEREAS, Ring Financial, Inc. has applied for Planned Unit Development <br /> development plan approval to construct 345 apartment units, an approximately 38,781-square- <br /> foot retail center consisting of four buildings, new surface parking, and related site <br /> improvements on an approximately 16-acre site located at 3150 Bernal Avenue ("the Project"); <br /> and <br /> WHEREAS, zoning for the property is Planned Unit Development — High Density <br /> Residential (PUD-HDR) and Planned Unit Development— Commercial (PUD-C) Districts; and <br /> WHEREAS, the Planning Commission adopted Resolution 2013-35, determining that <br /> the proposed development plan is appropriate for the site, making findings, and recommending <br /> to the Pleasanton City Council that PUD-87 be approved; and <br /> WHEREAS, on August 6, 2013, the Pleasanton City Council held a duly noticed public <br /> hearing on this application and considered all public testimony, agenda reports, and related <br /> materials, and the recommendations of City staff and the Planning Commission; and <br /> WHEREAS, the City Council finds that the exceptions to the Housing Site Development <br /> Standards and Design Guidelines as stated on pages 15-17 of the July 10, 2013, Planning <br /> Commission staff report are appropriate; and <br /> WHEREAS, the City Council determined that the conditions described in California <br /> Environmental Quality Act (CEQA) Guidelines Section 15162 have not occurred and found that <br /> the previously prepared Supplemental Environmental Impact Report (SEIR), including the <br /> adopted CEQA Findings and Statement of Overriding Considerations in City Council Resolution <br /> 12-492, and the Addendum to the SEIR for the Project are adequate to serve as the <br /> environmental documentation for the Project and satisfy all the requirements of CEQA; and <br /> WHEREAS, the Pleasanton City Council finds that the proposed PUD development plan <br /> is consistent with the City's General Plan and purposes of the PUD ordinance, and by this <br /> reference adopts and reaffirms all of the considerations and findings set forth in Planning <br /> Commission Resolution 2013-35. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council approves Case PUD-87, the application of Ring <br /> Financial, Inc. for Planned Unit Development development plan to construct 345 apartment <br /> units, an approximately 38,781-square-foot retail center consisting of four buildings, new surface <br /> parking, and related site improvements on an approximately 16-acre site located at 3150 Bernal <br /> Avenue, subject to the conditions as shown in Exhibit A, attached hereto and made part of this <br /> ordinance by this reference. <br />
