EXHIBIT A <br /> DRAFT CONDITIONS OF APPROVAL <br /> PUD-97 <br /> 4202 Stanley Boulevard <br /> 13 Lot Single-Family Home Development <br /> August 20, 2013 <br /> PROJECT SPECIFIC CONDITIONS <br /> Planning Division <br /> 1. Should limited, commercial, office and/or personal services be desired for Lot 13, <br /> Ponderosa and/or the responsible party shall apply for a PUD modification for <br /> rezoning and a General Plan and Specific Plan Land Use amendment. <br /> 2. Should the applicant and/or responsible party wish to retain and use the unit on <br /> the second floor of the existing home on Lot 13, the applicant and/or responsible <br /> party shall ensure that the space is deemed habitable by the City's Building and <br /> Safety Division and Livermore-Pleasanton Fire Department. T-iis may require <br /> the applicant and/or responsible party to submit plans for review and approval by <br /> the Chief Building Official and Director of Community Development and pay any <br /> related fees that the unit may be subject to (e.g., plan check fees, water <br /> connection fees, etc.) prior to using the space as a residential uniā€¢:. <br /> 3. Should Ponderosa Homes and/or the responsible party receive approval to <br /> subdivide Lot 13 from the development, Ponderosa homes and/or the <br /> responsible party shall enter into a Landscape Maintenance Agreement with the <br /> City for Lot 13. Said Agreement and related materials shall be submitted to the <br /> City Attorney for review and approval. Said Agreement shall be required prior to <br /> approval of any minor subdivision map. <br /> 4. Ponderosa Homes shall be required to invest a minimum of $30,000 for a new <br /> roof, exterior paint and landscaping improvements for Lot 13 prior to occupancy <br /> of the project units. Ponderosa shall submit a final landscape and irrigation plan, <br /> elevation drawings or a photomontage and a color and material board of the <br /> proposed roof color and material and building paint colors for Lit 13 for review <br /> and approval by the Community Development Director prior to commencement of <br /> the work taking place. The landscape plan shall note the size, location, <br /> number/amount and species of the plants. Plant species shall be drought <br /> tolerant in nature with an irrigation system that maximizes water conservation <br /> (e.g., drip system). All trees used in landscaping shall be a min mum of twenty- <br /> four box-size and all shrubs shall be a minimum of five gallons. An itemized list <br /> for the cost of improvements (i.e., new roof, paint and landscaping) shall be <br /> submitted to the Planning Division upon completion of improvements. <br />
