ATTACHMENT 3 <br /> SIXTH AMENDMENT TO AGREEMENT <br /> This Sixth Amendment to Agreement ("Sixth Amendment") is entered into this day of <br /> 2013, by the City of Pleasanton("City") and T.Y. LIN INTERNATIONAL ("Consultant"). <br /> Whereas, on July 20, 2010, the City and Consultant entered into an Agreement for Professional <br /> Services ("Agreement") for the preparation of Plans, Specifications and Estima:es (PS&E) and <br /> Environmental Certifications for the I-580 Interchange Improvements at Foothill Road (Agreement 10- <br /> 663C); and <br /> Whereas, on July 19, 2011, the City and Consultant entered into a First Amendment to the <br /> Agreement for Professional Services for the preparation of retaining wall designs, supplemental traffic <br /> forecasts, and an updated Natural Environment Study(NES) for the Interchang;; and <br /> Whereas, on January 17, 2012, the City and Consultant entered into a Second Amendment to the <br /> Agreement for Professional Services for the preparation of retaining wall hard copy mapping, right of <br /> way appraisal and acquisition services, and a utility encroachment exception; and <br /> Whereas, on March 31, 2012, the City and Consultant entered into a Third Amendment to the <br /> Agreement for Professional Services for additional information and exhibits for the Natural <br /> Environmental Study (NES), including information on vegetation communities and additional exhibits, <br /> discussion on the presence of California Red Legged Frog and Alameda Whipsnake habitat within 3,000 <br /> feet of the project limits; and <br /> Whereas, on July 17, 2012, the City and Consultant entered into a Fourth Amendment to the <br /> Agreement for Professional Services for one additional pothole, as required by Caltrans, of the gas line <br /> in the area between the existing EB off-ramp and EB loop on-ramp; and <br /> Whereas, on June 7, 2013, the City and Consultant entered into a Fifth Amendment to the <br /> Agreement for Professional Services for providing assistance as required during the advertising and <br /> bidding period in order to respond to questions from contractors, attend a pre-b id meeting; and assist <br /> City staff in preparing contract addenda; and <br /> Whereas, the Consultant's assistance is required to provide design services during construction <br /> to respond to request for information from the contractor, review contractor submittals as required, <br /> provide geotechnical oversight and assistance, attend meetings, and prepare construction record <br /> drawings; and <br /> Whereas, the parties desire to amend the Agreement; <br /> Now, therefore, the parties agree as follows: <br /> 1. Section 1 of the Agreement is amended to expand the scope of services to include design <br /> services during construction to respond to request for information from the contractor, review <br /> contractor submittals as required, provide geotechnical oversight and assistance, attend <br /> meetings, and prepare construction record drawings. <br /> 2. Section 4 of the Agreement is amended to increase compensation by$84,724, for a total <br /> compensation amount of$616,918. <br /> Page 1 <br />
