ORDINANCE NO. 2070 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING PLEASANTON MUNICIPAL CODE CHAPTER 7.36 (MISCELLANEOUS <br /> ANIMAL REGULATIONS) TO REGULATE THE CARE AND TREATMENT OF <br /> ANIMALS <br /> WHEREAS, sections 597 and 597.7(d) of the California Penal Code permit the <br /> prosecution of laws regulating the care and treatment of animals under those sections or any <br /> other provision of law, including city or county ordinances; and <br /> WHEREAS, although the Pleasanton Municipal Code currently regulates the cleanliness <br /> of the premises where animals are kept, the Municipal Code does not regulate the protection of <br /> animals from the elements, treatment of sick or injured animals, or supply of adequate food and <br /> water for animals; and <br /> WHEREAS, the Police Department would like to better safeguard the health, care, and <br /> treatment of animals through local regulation by having a more comprehensive approach to <br /> regulating animal welfare. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Chapter 7.36 (Miscellaneous Animal Regulations) of the Pleasanton <br /> Municipal Code shall be amended as follows: <br /> Sections 7.36.010—7.36.050, no changes. <br /> Section 7.36.060 (Protection from the Elements) <br /> No owner shall leave or confine an animal under conditions that endanger the health or <br /> well-being of the animal due to heat, cold, lack of proper and adequate shelter and protection <br /> from the elements, lack of adequate ventilation, or lack of food or water, or other circumstances <br /> that could reasonably be expected to cause suffering, disability, or death to the animal. <br /> Section 7.36.070 (Food and water) <br /> Every owner shall supply each animal food and water daily. The food shall be <br /> wholesome, palatable, free from contamination, and of sufficient quantity and nutritive value to <br /> meet the normal daily requirements for the condition and size of the animal as specified by a <br /> veterinarian. The water shall be clean, free from debris, and regularly changed. <br /> Section 7.36.080 (Treatment of Sick or Injured Animals) <br /> Any animal requiring medical attention shall be taken for examination or treatment to a <br /> veterinarian at the owner's expense if the Chief of Police finds that an examination or treatment <br /> is necessary in order to maintain the health of the animal. <br /> SECTION 2. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br /> City Clerk's office within fifteen (15) days after its adoption. <br />
